Whiplash Claim... So unfair

Hi, I really need help as I do not know what to do. Please ignore my ignorance as this is my first lil accident on the road. I will cut the story short..

Back in January while I was in moving traffic I lightly bumped into the car in front of me... driving at least 3-4mph. As soon as the guy got out he complained of whiplash etc and wanted me to give him cash instead of contacting his insurance company. There were no damages on either vehicles. Overall, the guy was veryyy dodgy and just seemed like he wanted money.

I told my insurance company what happened as the other guys insurance company contacted mine.

Fast forward to July, I recently came back from holiday and I received a letter which has been hand posted by QuestGates a claims specialist telling me to contact them. I contacted my insurance, Churchill and they told me to speak to QuestGates as they wanted me to give a verbal and signed statement. Churchill had told me the guy I bumped into has claimed for whiplash and has medical support by experienced doctors and there is nothing I can do because they sad they are not going to court as it will cost them thousands.

I thought it was strange that a claims specialist is contacting me and he wants to come to my house and arrange a meeting. I told my older brother and he said it seemed a bit dodgy why my insurance company is not dealing with it. I do not know either... I know for a fact this guy claiming for whiplash is a whole scam and I feel like even though yes I did bump into him, I am being cheated because I have been told whiplash cannot actually be screened.

I feel slightly lost as Churchill are no help. Is this guy from QuestGates suppose to take a verbal and written statement for the other guy to make his claim successful? What if I don't want to meet with the QuestGates guy and ignore him?

    If you have third party insurance, it is down to them.

    Sounds like the guy claiming for whiplash needs your statement to back up his claim, which your insurance are not fighting. Call them and ask why they need to see you in person when you have already explained what happened to your insurers.

    And then people are outraged by the cost of insurance.

    Unfortunately you had an accident and hit someone else. If he has documentation from medical professionals that he has whiplash, whether it is true or not, there is little point Churchill spending tens of thousands defending the claim.

    Do you have any evidence that he was not injured other than you don't want to pay him?

    By not giving a statement it may hold up proceedings a bit more but it just means that eventually it will definitely go in the victims favour.

    I'd suggest speaking to Churchill again, but make sure that you do speak to the department dealing with the PI claim and not the ones that would normally be dealing with the damage to your car.

    Would also confirm who has instructed the claims company to make sure it isnt Churchill that have

    maginot: Well, the guy was fit enough to go work straight after. He kept saying he does not have time to deal with this otherwise he will be late for work..Also, as soon as he got out of the car he complained of neck injuries. When I told my insurance company the first time I spoke to them the lady said you would not usually get neck injuries straight away. Well, at the end of the day he has managed to get medical papers.

    It's irrelevant though. Yes it sounds like he could be pulling a fast one. But he has proof and it is up to you to disprove it. Unless you follow the guy around and catch him competing in a gymnastics competition doing treble somersaults, which you then photograph, you aren't going to get proof. (Please don't follow him, you will get yourself into bother). It's annoying, he shouldn't get away with it, but he probably will.
    I have had many Light Bulb Moments. The trouble is someone keeps turning the bulb off :o

    Sign nothing, just refer them to your insurers.

    Why are you getting so concerned about this? You pay your insurance company for cover, and they cover you for any claims. It's their money at stake, not yours. If they dont want to contest the claim it's their call.

    Simply tell Quest Gates and any one else contacting you on the matter to deal with your insurance company. Dont talk to them yourself - you could inadvertantly say something that makes the situation worse.

    Ask your insurers if they have instructed Questgates to obtain witness evidence from you. That is the most likely explanation for them contacting you.
