Sure it's maybe a stretch, but if I can make a few deals when I get my business off the ground then I may be able to justify loss of earnings based on the earnings that I've generated during a set period. This is all speculative though, it's not something I discussed with my lawyer.
You can't prove any loss of earnings because it is just a plan in your head at the moment.
If you already had a business and the local council closed the road and you lost business, you could prove that it had an effect on your business and you would have a basis for a claim.
You chose to leave your job and now you are saying you blame them for loss of potential earnings for a business that only exists in your head.
For that reason, I'm out. There are three types of people in this world. Those who can count and those who can't.0 -

Absolutely. This is what I meant when I said that I would consider it if I get a few clients during a set period of time. For that reason, I'm out.

To be honest pal I think you ought to cut your losses and just move on. You were clearly in the wrong for breaching your contract, so just let it go.

I currently do not have the money for the laptop which is needed for the sales presentations and some extra training materials which would total about £200-ish.
Of course, as I mentioned already, I would need to close a few deals during a set amount of time to justify any loss of earnings otherwise it would be baseless which is why I said it's just speculative at this stage.
speculative or more a fantasy
Send me the powepoints I will check the viability
I have a laptop spare, done training before etc.0 -

The employer has every right to withhold your pay. You left them in the lurch. Other people had to pick up your workload. Whether youve worked there for a week or a year, you have to give notice.
A few posts on here though have made me chuckle a little though.0 -

Do you not have a NDA? It would come in useful in situations like this. If you are going to be using "online labour" you will need one.0 -

Oh grow up!HoldOrFold wrote: »I don't believe I mentioned this already, but I didn't give notice because I thought in the contract it meant it's optional. It says you "may" give notice during your probation but you "must" give notice after. Feel free to call me stupid, but I thought that's what it meant.

The problem with these types of threads is that we will never know how the OP will get on with the tribuninal. He/she might come back just to tell us if they win, but if they lose well, snwballs in hell come to mind when thinking about whether they will come back here.0
