Civil enforcement parking contravention

Hey I was just hoping for some reassurance on 5th July I received a letter from civil enforcement ltd I was advised my friends family and on here to ignore it ive been told they will send a few letters but won't take me to court as it will cost them too much. Well 25 days after my first letter I've received a red letter saying this is my final reminder to pay the £150 otherwise they will issue a county court summons and may then issue a warrant to bailiffs to recover the amount due I will incur court fees bailiff costs and interest it also says my credit will be affected. Am I still ment to ignore this letter and hope they are bluffing when they say they will take me to court. Would love some reassurance from anyone who's been in the same situation. Thanks

Civil Enforcement Ltd do not and never have done court. It is an idle threat intended to separate you from you hard earned. You can safely ignore their threats.
You'll probably see a debt collectors letter next. Just remember that debt collectors have exactly the same legal powers as you and I to collect debts - except they don't want you to know that, hence the semi-legal wording and the threats. The giveaway is liberal use of weasel-words like "if", "may" and "could".My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).
For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com0 -
Check that letter. Does it really say "will issue", or does it actually say "may issue"?... pay the £150 otherwise they will issue a county court summons
They can't issue a warrant. Only the court can do that. That would be the court they will fail to go to, and at which they would surely lose if they did. And even if they didn't, only your failure to pay would actually enable a warrant to be issued to recover anything. It's all bluster. Ignore.... and may then issue a warrant to bailiffs to recover the amount due I will incur court fees bailiff costs and interest it also says my credit will be affected.0 -
Im on the take to court stage, they say they have been left with no alternative but to instruct their solicitors to draft particulars of their claim which they intend to submit to northampton court 10/08/12.
the only worry i have is people mention a change in the law april 2012?
anyone any advice please?0 -
:rotfl:What a joke! Complete b*****ks, of course.CYANIDE_SID wrote: »Im on the take to court stage, they say they have been left with no alternative but to instruct their solicitors to draft particulars of their claim which they intend to submit to northampton court 10/08/12.
What change in the law would that be? If you mean the Freedom Act, then (a) the "keeper liability" part doesn't come in until October and (b) it will make no difference to the illigitimacy of the parking charge notices issued anyway.CYANIDE_SID wrote: »the only worry i have is people mention a change in the law april 2012?

I thought it was unenforceable from what i had read here, as it was for parking over two hours in a free car park.0

It is unenforceable. The landowner would be legally entitled to the actual financial losses incurred, which, in a free car park, would be... ummmm.....errrr.... hang on a minute..... (hand me that calculator....)....errrr..... zero!!Je Suis Cecil.0

Then, all the car park owner can legally claim from you is their losses of £0.00. However, the PPC can still try to blackmail you. Intention is not the same as action. Personally, I'd ring them on 13 August and ask for the case number. The acquisition of wealth is no longer the driving force in my life.

They will also send you fake court papers which don't have a court stamp. So if you get any just come back to checkFor everthing else there's mastercard.
For clampers there's Barclaycard.0 -
Thanks for all the comments, since that letter ive now had another one saying that because i havent paid they may now pass my details onto there solicitors who may issue me with a summons from northampton county court which i dont know why when im in west yorkshire and there supposedly from liverpool but they were kind enough to explain that they understand that times are hard at the moment and they understand that £150 is alot of money so they explain that if i just paid the £75 now they would be happy to let things come to an end. Im still ignoring the letters and havent had anything for about a month although i am expecting to receive a few more threatening letters and court papers but im staying strong and hoping they dont actually follow through0
