My milkman is awful!

I used to use Milk & More when I lived in a different area to help support the local milkman and he was wonderful. He would use the cool box I provided, the milk was always there by 6am and my orders were always complete and in perfect condition.
I moved to a different area a year ago and straight away noticed that the milkman was not as good. My first order with him was for a milkbag and this was for some unknown reason left in a muddy puddle in the empty flowerbed rather than on my doorstep. I sometimes leave my kitchen compost bin out near the door and one morning I couldn't find my milk, a couple of days later I found it had been put in the filthy compost bin on top of the rotting food waste! I live on a quiet cul de sac and my front door isn't visible to the road so there's no need to hide my orders. I've had orders that have had stuff missing or wrong, he never collects the glass bottles and the one time I ordered eggs and oranges both were damaged. I order organic milk and often get regular milk instead. The final straw was a few days ago when it was really hot I put out a cool bag (one I had bought specifically from Milk & More) and put ice blocks in it to make sure the milk was fresh. The next morning there was a warm bottle of milk next to the cool bag which was left empty!
I have called over and over again to complain but Milk & More just add credit to my account which don't get me wrong is great because I end up with free stuff but I ask them to pass on my complaints about the service and I'm sure they don't. This milkman needs some retraining or something because the service is awful. I cancelled my orders ages ago but Milk & More keep phoning me and offering me free orders. I explain the reason why I don't order from them and tell them that I've complained over and over again but they really don't seem to be interested at all.
Its a shame really because I was trying to support my local milkman as I know they've had a bit of a rough time over the last few years but the service is just awful and no-one seems interested in doing anything about it.

I would have said it almost sounds like he's aware of a theft issue in the area and is trying to hide your order, but, umm, the last bit about not putting it in a cool box belies that.
If you can't get M&M to do anything about it, well that's their (and the milkman's) loss I suppose. When he's driven all his customers away with poor service, no doubt they'll look into it."So long and thanks for all the fish" :hello:0 -

However I will advise from a legal perspective, as there has been a clear breach of contract here, the moment he steps on your property he is committing trespass. Although it is unlikely you could build a case around this alone, when we add the ongoing contractual breaches and the general 'contra bonos mores' acts I think a small claims court summons could be issued to the guilty party i.e. the milkman
Perhaps I missed a joke but what are you talking about? Trespass? Taking the milkman to court for leaving the milk next to the cool bag and delivering regular milk instead of organic? I'd be embarrassed to hear about any court that took a claim like that seriously.
Either the OP has placed an order with Milk and More, in which case has given consent to the milkman entering their property, or the OP hasn't placed an order, in which case the milkman won't be there in the first place to 'trespass' (unless you think he visits at 5 in the morning for no reason?)
If the OP wanted to use Milk and More again (to give them another chance) they should perhaps consider leaving a note for him/her with some requests regarding where they'd like the milk left (eg. "In warm weather, I'll leave a cool bag on the step - it would be great if you'd pop the milk in there") to try to help what appears to be a pretty rubbish milkman with some common-sense tips.
If the OP is sick of Milk and More (and who could blame them), then they can/should cancel their account and advise them that they no longer wish to be contacted by phone or any other method. If they continue to harass the OP then the OP should act accordingly but really I don't see where trespass and taking the milkman to court comes into it.

i had a lovely milk man who then sold his round to people who didn't really care. our used to come every two weeks for his cash, new people would just stick the bill through the door even though i was in, a small thing but i didn't want to leave cash on the step, why they just couldn't let me pay them then was beyond me plus sometimes the milk arrived early but some days it didn't arrive until after 9am so it would be on the step all day going off nicely. in the end i gave up on them, and most telling so did most people in my street'We're not here for a long time, we're here for a good time0

You can go off Milkman, can't you?"You were only supposed to blow the bl**dy doors off!!"0

Haven't used a milkman in years - they would deliver us milk on the use-by date, which was not good, and if you were out for they day you could come home to find it had gone off.
You can get fresher by going to the supermarket.0 -

This poster is a newbie who is posting inflammatory and inaccurate posts on various threads. Far from being in the legal profession they are coming across as a troll. Best to ignore. The advice is garbage anyway apart from being incorrect.0 -

I can get even fresher milk than the supermarket, and never run out of milk. The joy of living on a dairy farm0 -

I'm not usually taken in so easily by trolls - I guess this one got me!
I was looking forward to hearing him/her explain their logic to me: difficult to do when there isn't any to explain.
Thanks!0 -

Gah, I spotted it straight off. I assume Advisory Service is true (or more likely an older forumer on a new account ripping the pee out of it all)
I have to admit, sometimes my Milk and More delivery is later than 9 am. Most days actually. But as I worked from home (and "self employed" now) it's not really an issue for me. Half the time I forget it's there!
M&M is slightly more expensive than the supermarket but, I don't mind. I reason I'm giving a guy a job and I never ever run out of milk so it's worth it for me."So long and thanks for all the fish" :hello:0
