  • I have had a fine from HMRC today (£400) for not submitting my PAYE year end P35 & P14 documents by 19th May 2009.

The company in question has been dissolved and did not trade or have any employees during the tax year in question.

Did i need to complete the P35 & P14 documents for the company?

Dose anyone know if I am personally liable for the fine?

Have p45's been issued for all the employes and directors?
Have you notified the office dealing with PAYE that the company no longer employs anyone?
If you do the above, then you wont need to complete a P35 and HMRC will cancel it if you notify them.

    Thanks for info fengirl.

P45's were issued at the end of 2007 for all employees.

the company is now shut down but I can't remember if we informed PAYE people at HMRC.

I will give them a call on Monday to see if they can cancel the fine.

Although you issued P45's, you have to inform the PAYE office that you will no longer have employees.

  • Finally got through to the idiots at HMRC and they have admitted that I had closed everything down correctly and that the fine had been sent in error but they can not cancel it until I put my appeal in writing.

So now I find myself writing letters to appeal against a fine which was sent in error to a ltd company which no longer even exist.
