receive a Notice of eviction letter from council, what can i do now?

    we received the eviction notice from council behalf of the building society Shoosmiths.

    Shoosmiths? Solicitors acting on behalf of the mortgagee?

    Yes pretty sure there is no Building Society called shoosmiths. I have never known the council get involved in a private eviction either, can't see why they would unless the tenant is renting the private property via the council. The council house many of their homeless list in private properties which they rent via contract with the owner and then provide short term tenancies to the tenant directly. However if they wanted to evict anyone they would have done so in far gentler means than this, or will have attempted to for sure.

    I have wondered about creating a 'sticky' about the information needed if you are posting about a tenancy agreement/landlord problems but then I don't suppose anyone would read it :rotfl:

    As regards this 'problem' I am sure that the OP hasn't given us the full story. If this is an eviction because of repossession wouldn't the OP had previous letters about this?

    If they are renting through a letting agent why hasn't the OP telephoned them to ask about the deposit?

    I am also confused about the council's involvement but I suspect the OP's first language isn't English so is a bit muddled about it all.

    Shoosmith is a law firm, I believe, so is probably acting on behalf of the lender. Perhaps the bailiffs being used are the same ones as those used by the council ?????

    I thought you had to have been issued with a court order before they could send the bailiffs to evict?

    If the OP has English as a second language it may be worth visiting CAB with all the paperwork rather than telephoning Shelter. Easier to deal with face to face rather than on the phone.


    PS. Mmmmmm OP's previous posts suggest that they want to get council housing. Perhaps they have been told to wait for the eviction order to be classed as homeless. If that is the case then they need to take the eviction order to the council and speak to the Homeless Officer.

    In our area being made homeless doesn't get you council housing. If you are classed as vulnerable, ie mental health or have children or are pregnant they will accept you as homeless and help to find you accommodation. This can be private rented properties rented via the council, or B&B until other private rented is found or a hostel with shared kitchens and bathrooms and that can be longer term. I don't know anyone that has managed to get into a council property here having been homeless before.
