receive a Notice of eviction letter from council, what can i do now?

Hello everyone, I would be grateful for some advice of my situation, we are renting privately with housing benefit at the moment, we received a letter of notice of eviction today said will take action on 5 of sept and we can't contact our landlord at all ( think hes aboard). we surely do not have time to find another property and we also short of money to do this as well as landlord hold our deposit and we just paid the August rent to him (we normally pay him immediately once we receive our housing benefit each month). so now we are very worry and don't know what to do. please help.

Forgive me, but your title is 'eviction notice from council' yet you say you rent privately.
So we can answer your question and check everything can you please answer the following questions?
Are you in England/Wales or Scotland (rules may be different)
When did your tenancy start? How long is it for?
What kind of eviction order have you received? Have you received a Section 21 or a Section 8 or both and/or court papers with an eviction order?
Is your deposit protected and have you received information about this?

i received a letter from council behalf of the firm, as follow: the court has issued a warrant for the possession of the above property at the request of the claimant. the warrants gives a county court bailiff the authority to evict you and hand over possession to the claimant. this notice tells you the time and date when the eviction will take place, what will happen on that date, and what you can do....
our contract start 15 of aug 2011, and we live in london. no Section 21 or a Section 8 or maybe will receive it in the next few days. we rent it though the estate agent and i think the deposit is protect but not sure....please advice. thanks so much0 -
Is this letter the first you heard from your landlord that they wanted you to leave?

Is "the claimant" the mortgage lender or the landlord?RENTING? Have you checked to see that your landlord has permission from their mortgage lender to rent the property? If not, you could be thrown out with very little notice.

If, as paddedjohn implies, you are renting from a 'landlord' who is actually the tenant of the council and therefore has no right to sub-let the property, then I don't think you have a leg to stand on.
People are allowed to rent a property from the council because they are in need and can't find a property to rent or to buy in the private sector. Sub-letting a council property is a scam, is strictly illegal, and is robbing not only honest council-tax payers but others who are being denied access to a council property by legitimate means. There are hundreds of thousands of people on any council's waiting list.

Something doesn't quite add up.
The council aren't likely to be doing the eviction (they will only be directly involved in the eviction of a council house or if they were the lender) but , at least in some arrears, the council receive notice of evictions so that they can try and catch those who need emergency accommodations. Are you sure this isn't what you received ?
The other possibility is that the landlord used one of the council schemes that lend money for mortgages and the landlord has defaulted on this.I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.0
