Yes. I have got to admit, I looked through the OP's "evidence" that the dismissal wasn't performance related and came to the conclusion that based on his side of the story, it wasn't convincing that it wsn't performance related. I am afraid that this is probably going to come to a very painful end for the OP. They don't want to hear sense.0 -
This link has info on how the ET look at discrim cases which may help http://www.compromiseagreement.org.uk/site/employment/legalnews/burden_of_proof_in_discrimination.html
Have you sought legal advice? CAB, law centre or legal expenses cover through insurance? They are best placed to advise on your strength of case and analyse the risk factors for you. A discrim case is generally lengthy if it proceeds to hearing as there are usually lots of witnesses involved, on both sides, this in itself adds lots of stress, with no guarantee of a positive outcome. All ET proceedings are a matter of public record and that has to be considered for the future, local journos will routinely check the listings for 'interesting' cases.
That being said, I too am struggling to see a discrim angle from the facts outlined...0
