There are many ways to detect tethering, and basically it's partially as laptops use a lot more data than smart phones and also as they want to charge extra to tether.
Software solutions are NOT perfect, there are many PDANet users in the US that have reported they have been detected when tethering.
However the networks actually detecting it and doing anythign depends how much data you use, as you say as long as you are not using excessive amounts they probably won;t do anything.0 -

I've been using my T-mobile plan with unlimited "Internet Booster" for the last 18months with no problems, regularly tethering and browsing all day when I am at a site with no internet.
I was even discussing it with a T-mobile technician the other day when I was (unsuccessfully) trying to use the internet via bluetooth.
He does the same (tethering) as he was advising me to use the wifi tether instead.0 -
I'm pretty annoyed about this. I said I wanted it to use it for internet access while travelling and the T-Mobile store happily sold me a PAYG deal for the Internet Travel Booster, without mentioning this restriction. The phone can act as a wifi hotspot as a standard feature, so I expect to be able to do that unless it's explicitly excluded. So, I circumvented it with one of the easily-obtainable apps (I feel justified in doing so because I was abroad and couldn't easily raise this mis-selling with T-Mobile or get another SIM, and I bought this for that purpose) and as soon as the credit's gone, I'll not use the T-Mobile SIM any more. Also, if they're going to give me a data limit, why do they care if it's tethered or not?Looks like T-Mobile have pulled the plug on tethering with the Full Monty package with a phone now. Looks like the only option left with unlimited tethering contracts is with 3.
In my recent tour of the mobile shops, the only salespeople to mention hotspot use at all were from Three, who said it was allowed. It's a shame they have no data travel offers. Are Three the only ones who allow tethering at all, or are the others just failing to mention it either way?0 -
See post #2. Three only allow it on the One Plan. O2 seem to be the only network to allow tethering on all contracts at no extra cost.0
