Does anyone know if when DLA Mobility is stopped because you leave GB it is reinstated when you return.
The question arises because my mother became 65 during the time she was abroad and is being told she cannot have the DLA Mobility back as she is over 65. Strange because they have reinstated the Care Component even though she is over 65.
Do we appeal or not?

I think that would mean her claim was discontinued when she left the UK and you can't make a fresh claim for it when you are beyond the age of 650

Her DLA would have ended 6 months after she went abroad, so I assume this award is the result of a new claim. In that case, are you sure she has been awarded DLA care - or is it attendance allowance which is the relevant benefit for the over 65s? There is no equivalent of DLA mobility for the over 65s (unless they were already getting it before they turned 65).0 -
It is DLA care that has been reinstated she has never applied for AA. The DLA was awarded for LIFE which in the case of care means until you die but for mobility means until we decide.
My mother came to live we me in France following my father's death. Since we returned to the UK I have applied for Carers Allowance and it is now being paid to me.0 -
DLA care can port around the EU but not mobility.
When you leave the UK you keep care but the mobility award expires. Just like all DLA awards that have expired the mobility component must be reapplied for when the applicant re-enters the UK to live. If they no longer fit the criteria (over 65 or no longer virtually unable to walk) then they cannot get an award even if their previous award was "for life".0 -
If the DLA (Care) stopped when she lived in France then she should appeal this as it became portable within the EU and she ought to be able to get it back dated for the period she was abroad.0

I don't think from reading the OP that it did though because it would never have been re-instated when the OPs mum returned to the UK as she is no longer eligible to claim DLA.0 -
DLA care award for LIFE, doesnt mean until you die.
they can reassess at any time and it can be removed of the care needs arent deemed sufficient.
a 'for life/indefinate award is totally misleading0
