If the extension foundation is not deeper than the adjoining property then the Act does not apply and the award is not worth the paper it is written on.
You are legally entitled to build right up to your boundary but you have no rights to gain access to your neighbours land to build it. The simplest way around this is to explain to your neighbour that if they refuse access they are the ones who will be looking at an ugly blockwork wall, not you. I've yet to see someone who still refuses access after that.0
