My employer is accusing me of fraud as he is retaliating me of raising whistleblowing

  • You had advice from a barrister at the other site you were advised to visit - and you were told that you must get a lawyer. So why are you still asking here, two weeks later, what you should do? Do as you were told and get a lawyer. If SarEl thinks you need a lawyer, then I very much doubt that you don't!

    Thanks. I have been suspended with pay. My manager wants me to come in so that I can tell him about my grievances. If the grievances are against my manager, how should he be the one to hear the grievance? So, i told him I disagree for him to be at the grievance meeting. He then said he will get one of his subordinates to hear the grievance. This subordinate is new in the company and of course, he will not go against my manager as he may loose his job as he is still under probation. I asked my manager if we can compromise and if he can let me go. Surprisingly, he said no because I have told all the complaints to his bosses who were not aware of it previously. He said he wil put me into trouble by saying the increment letter was forged by me and saying because of that, I stole money from company. I promise that I never did that. He then said if he has to fight, he will go to tribunal, county court and will call police. Of course, this frightens me as I would need to incur lots of costs to fight my case and it is going to be his word against mine. during this period of time, no one would recruit me without a reference letter. I am getting crazy with all this is happening. Can someone please help me? I was told to get a lawyer but speaking to many lawyers, they say I could incur legal fees of more than 7000 pounds. I dont have the money to do so. My manager has got his lawyer to keep sending me letters. My manager is able to pay his lawyer as the company can afford to do so. I am tempted to contact my manager's bosses to explain my side of the story but I am afraid that they might tell my manager and that would be a problem as my manager has told me not to speak to anyone in the company when i am suspended.

    What should I do? I am completely lost.

    You really need a solicitor/lawyer. I think this is beyond any of us and if SarEl has told you to lawyer up, you need to.
    Data protection is there for you, not for companies to hide behind

    Someone has helped you, and I don't know why, but they have told you flat out that you need a lawyer. And it was a lawyer who told you that, so I am going to guess that they knew you needed one.

    You are playing the same lines over and over. What do you expect of us? We are not lawyers.
  • I can hardly read your posts as there are no paragraphs etc and its just a jumbled up ranting mess!

    Who has told you a lawyer will cost £7K? there are many lawyers out there that give the first hour for free.

    why won't you go to the disciplinary hearing? can you write or get someone to write a letter to the board of directors on your behalf asking for a hearing with someone neutral?

    I honestly think you are either making a mountain out of a molehill and getting things jumbled in your panic or your boss it using your panicked nature to push you out the door.

    He cannot employ lawyers of his own to deal with a company matter, its impossible that it would happen. Perhaps you could call whoever sent you the letter and ask them to clarify who they are and why they are writing to you?

    better still, give up work and take your boss for constructive dismissal. You must have had a very important position if your boss is going to such lengths to hush things up and get you out.

If he was claiming you frauded him/the company then it would take the police a few minutes to clear the matter up and see that there is no complaint to answer. If you think it is the company, then i'm very surprised that they would pay for a lawyer for an employee (which your boss is) that has had allegations raised against him and i'm sure they'd question the cost of lawyer letters to deal with a disciplinary hearing that they've never been aware of until now.     you have had a lot of good advice here and the first thing you need to stop is panicking. You are behaving like the !!!!! is after you. Contact the employment relations people in your area or citizens advice if you need to. You have also been offered advice here and on another site. pull yourself together or you'll end up taking a coronary

    Stop it OP. Stop. Stand still and calm down and stop panicking!

    FYI: Paragraphs don't only help us they help you break your thoughts down and order yourself.

    You need to take everything you've got, in a clear order and without emotion or fear and lay it in front of a solicitor. No "he's retaliating against me" no "what am I going to do" or "OMG I'm going to be destroyed!".

    Most areas will have at least one solicitors that have a evening clinic who you can go to on a sit and wait basis and get a 10-30 minute review from. They can advise you and give you and overview of how you sit (and will probably refer you for further work since you DO need it).

    We have said before you need to stop engaging your manager on these issues and go above him if you think he is stirring this up and manipulating the matter- forget what he says about not being allowed to. Telling them cannot add anything worse to the matter and that isn't a reason to avoid doing so.

    One thing I will say on this: This is all threats and if he really believed it he SHOULD be going to management and saying this and pursuing it. Instead he's trying to push you out of the door using it as a threat.

    By now if he really believed it you failing to come in for the investigation and disciplinary meeting would have resulted in them holding it without you and formally issuing you with dismissal etc. The fact they haven't and he is still trying to get YOU to make the next move and quit is very telling.

    Also employers can't take employees to 'tribunal' as far as I know. Tribunals are fore employees to use to say they were unfairly treated.

    The ball is in YOUR court here: take everything to a solicitor. Even if it does cost you a bit it can't be any worse than the current cloud that is hanging over you and possibly harming your health!

    I cannot divulge confidential details which have been disclosed to me by Terrified; but in the best interests of everyone, and especially Terrified, I do have to say that I am in possession of a great deal more information and facts than anyone here has been told. And based on that information, I am aware that posters here are, with the best of intentions, misadvising Terrified because they are, understandably, basing their advice on what has been said here. Please do not assume that this is a small company and a maverick manager who is acting without the knowledge or authority of the employer.

    There are very good reasons why I have advised Terrified to seek legal advice, and that is what he or she needs to do. I am most concerned that Terrified has not done so already. This is not a case for CAB, ACAS, or any other employment relations agency. The matters in questions are far too serious for them, and outside their scope.
