Err no. If you buy it as a trade sale you are deemed to have indicated to the retailer that you are trade and therefore it is a business to business transaction.

No. The difference with PC World Business is that they are specifically a business seller (although part of the PC World chain). As such, ALL their sales are trade.
For a company / trader that normally advertises and sells to the public, specifying a given sale as "trade" in order to circumvent CP laws isn't an option - in fact, it's specifically disallowed!0 -

It doesn't matter. The rules are quite simple:
You describe the car and point out any known faults. Those are NOT covered by SOGA because the buyer knows about them.
If other faults appear then you deal with them if they're serious enough to make a significant dent in the quality of the car.
If the car has so many faults (or you think it might) that the above isn't practical then you either sell it on to another nona fide trader, put it through an auction, or weigh it in.
What you don't do is play on the average person's desire for aa bargain by passing it off as "no problems I know of but it's trade so take your chance" because the average punter won't have the professional knowledge to make that judgement.
Bottom line is, a trader is supposed to know his stock and know if it's likely to be a dog. The law expects him to have the experience and expertise to do make these judgements as part of his business, and also says that when his professional knowledge suggests "dog" he's not allowed to pass it on to a member of the public by trying to "contract out" of their rights in return for a "bargain".
Good traders manage to do it the right way all the time. Like any other business, they might get the odd one wrong and lose a bit but, on balance, they get it right and have happy customers.0 -

Some on here would argue that SOGA would expect a 13 yo banger to be free of faults within the first six months of sale. The days of affordable older cars via the trade will be numbered if that becomes the case.
Its not the case.

The way I see it is as this - its an old nail he's taken in part ex, he places it on ebay to clear it out. He only wants to get shot of the thing and make his money back, so he doesnt want to be messing around digging out service history and describing it in magnificent technicolour to someone who wants it to be showroom perfect with a 3 year warranty.
If your interested go and have a look but if not he doesnt want people wasting his time.0 -
Unfortunately they probably get loads of calls like yours every day. If I was looking at a 13 year old anything (cars lol) I'd ask things like.
"does it start and stop ok?"
"any oil/fuel/water leaks?"
"what MOT's left on it?"

As some of you know I'm after an older 'prestige' diesel to run on vegoil. Saw a nice BMW 318TDS on ebay, some distance away, looked great.
Rang dealer today, almost the first thing he said to me was 'trade sale only, absolutely no warranty, its 13 years old what do you expect?' In, well, a slightly aggressive manner, then wouldn't give details on service history 'just whatever's in there'. So that one's off the list then...
Do they think this behaviour makes them sell cars easily?
Maybe Harveybobbles was just having a bad day?0
