Paypal Chargeback Question

I am sooooo mad!!!! :mad:

To cut a long story short, I bought a gift voucher from an ebay seller and paid by credit card. The total transaction cost £286. After Christmas, my OH tried to spend it and discovered the voucher was stolen. Therefore it had been cancelled by the company and so it was worthless.

I tried claiming against ebay and PayPal but neither were any help. PayPal said I was not covered under seller protection, as I did actually recieve goods and they only pay out if nothing was recieved.

After 4 months of arguing with my credit card over Section 75, they finally refunded my money 2 weeks ago. They said they were not obliged to do this, but gave me the refund as a goodwill gesture.

I've had an e-mail from PayPal this morning saying they have recieved the chargeback from my credit card. They say if the buyer sends proof of delivery within the next 3 days, I will have my credit card charged again for the full amount.

I'm not disputing the delivery and it was sent Special Delivery so presumably the seller may still have the documents relating to that. I got the refund as I bought something that was stolen and worthless.

What should I do now?

I thought this was all sorted out when I got the card refund, and I'll be so angry if they take the money back off me again.

    Is it possible to inform your credit card company to not allow any payments to be made on your card for a couple of weeks?

    Get back in contact with your credit card company and tell them what paypal have said. Tell them that you refuse to allow a further debit to be taken from your credit card.

    The credit card company have acted properly in refunding your money, they can now refuse a new charge on your account on your behalf. They might also be interested in paypals over the top handling of this.

    I know I defend paypal on this board a lot, however I am aware of their strange attitude that they operate above the law. I would always be the first to send people off to the credit card companies to reclaim from paypal when things go wrong, purely because if paypal get enough chargebacks against themselves they may well have to tighten up on their buyer protection.

    Let your credit card company and paypal fight this one out.

    I've spoken to Nationwide (card company).

    I have been told that they cannot block PayPal from charging my credit card. I argued and said that if they do charge, it will be without my authorisation which can't be right, but they still said they have to accept the transaction and query it later.

    If I am charged, I have to go through the disputes process again :(

    I'm confused here!!

    You are the buyer and you have received it. The seller has his ill gotten gains and must be happy.

    So who is going to charge your card again??

    Sorry for the confusion.

    I am the buyer and got a stolen worthless voucher and was not happy.
    After 4 months, Nationwide agreed to refund me as a goodwill gesture.
    Presumably Nationwide have sent the chargeback to PayPal.
    PayPal said they will now recharge my credit card, when the seller sends proof of delivery.

    Proof of delivery is not the issue. The seller selling stolen worthless goods is the issue.

    Yes i can see now the seller will have legged it with the money and PayPal will be out of pocket and will look to you to reimburse them..ouch.

    Hopefully the seller is long gone and doesn't reply to PayPal!!!

    Are they still trading??

    I think there is moral to this story...

    All vouchers (of serious value) must have a serial number which buyers should maybe ask the seller for prior to parting with the cash. This way you have proof it the same voucher which seller sends you and gives you the opportunity to check it is authentic.

    I would close the paypal account and if (when) they try and charge you report them for fraud! They do not have a leg to stand on.

    It might be interesting to note that deep in paypals t&c's is a bit about you waiving your right to use chargeback against paypal from your credit card firm. This has been seen in the US as an illegal contract (e.g. you waive your right in a contract to consumer protection - effectively makes the contract illegal and unenforceable). There are class action lawsuits against paypal for this in the US although I believe that they may have changed their US T&C's but not ours!!!!

    am i right in thinking that you've tried the police with no luck on this one? would it be worth a try again?

    the seller is clearly profiting through stolen goods/funds, so this a fraud case.
    This sounds like a nightmare, i would be spitting fire if i was you! if you could only get the police on your side, paypal and ebay may be a little bit more quick in acting against this (and the seller). This makes me pig sick

    By not preventing the seller from continuing, and by effectively supporting the dellers fraudulent activities, does this not mean Ebay and Paypal are also committing fraud?

    i dont really believe that paypal can charge your credit card without you aauthorising it. if they do then that is fraud and as soon as they do it contact your card issuer and inform them of the situation and they will deal with it.

    as for the bloke sending proff of post etc, he has his money and there is no way he will mess around with that. if he knew he was selling you a stolen voucher and he has already taken his money then do you really think he is still going to mess around sending proff to paypal. i doubt he still has the account open.

    paypal have shot themselves in the foot here and there is nothing they can do to you now they have refunded you

    Direct Debits on Credit Cards are strange things. Totally different to Bank Accounts, in that with a Bank Account you can phone the bank and cancel the DD, but with a Credit Card you can't.

    We cancelled my father-in-law's credit cards after he died, and 6 months later the AA took out his annual breakdown cover - when we queried it (after receiving the statement) with the CC company they said that there is nothing they can do to cancel DD's and need contact the AA directly and cancel the DD via them. :rolleyes:
