    Christ - legal advise? Calm dowm dear. Just go in and calmy explain that you are unhappy with how it has turned out and would like your deposit back as the car isnt going to be as discussed.

    Simples.

    If you go in quoting law and legal blurb then the dealership will be less willing to assist you.

    Just a thought to ponder.

    Now if the OP negotiates a decent discount will the dealer then sue the original buyer for any losses over and above the deposit?

    Yes, it would annoy me slightly, but if the car is "very popular new model with very long lead times" & it was the car I wanted / colour / spec I wanted, then it wouldnt bother me too much.

    Certainly it wouldnt bother me enough to wait for 20/30 weeks.

    Why not get the dealer to reduce the price and get some money off.

    You will be getting the same car with the same mileage at a good discount all for another name on the V5, wont make the car drive any different!

    This is a money saving forum after all!!!

    They've got no grounds to keep your deposit.
    I'd only bother with legal advice if they refuse to give you your deposit back.

    Personally I'd be asking for a goodwill gesture for messing you around and adding even more time on to when you can actually get your new car. But I doubt that you'll be offered anything better than a discount off another one, which won't be much help if you don't want to deal with them now.
    Up to you to see how much they'll knock off the price because of the registration issue and how eager you are to get one of these cars. You know that it is a new car. Does it actually matter too much to you what the piece of paper says?

    I had no intention of going in quoting legal blurb, I'm not an idiot thanks! I just think it's a good idea to know what the legal position is if you suspect that you're going to meet resistance -it's easier to stand your ground if you know you are right!

    I went to the dealer's today and I'm happy to say that they refunded my deposit without any quibble.

    I know to some people it wouldnt matter that the car was pre-registered, but if I wasn't bothered about that, I'd have been looking at nearly new or pre reg cars in the first place. If I'm paying a new car price, I want everything to be exactly as it should be, including the paperwork.
