And in the meantime your benefit is suspended or stopped, rent, council tax and school dinners are not paid for...

Or not on account of Atos running scared. One really shouldn't let this outfit bully you!!

The letter requesting a recorded assessment that someone has kindly posted on this thread should ensure that Atos stick to the rules.

Incidentally if Atos request clinical details from a claimants GP then if the GP is employed under an NHS contract then they are obliged to provide such details usually via an ESA113.

Atos will still expect him to go to the medical and won't talk to his GP, wether his GP will talk to them is irrelevant...

The op will not be able to change this or challenge the medical..

OP please check out the benefits & work website it will give you some amazing info...

I've just seen on there myself that there is 11 confirmed sets of recording equipment, as recommended by Proffessor Harrington, one per county is the idea...
It is impossible to get the medical recorded, they will tell you it's been booked and the day before they will suddenly say it's not been or the equipment isn't available...
Meanwhile your claim is cancelled due to your non-attendance...

OP do some online research and study what questions will be asked is the way to go...

The poster who stated they will ask social questions is right, they will look at how you got there, what you watch on tv, shopping, hobbies etc..

Take your pain relief/meds with you...
I always take the moral high ground, it's lovely up here...

If Atos carry out the Pre-Board check properly then if they require further clinical details then they will contact the claimants GP/Consultant via the issue of an ESA113.

A claimant requesting their assessment be recorded and are told that there isn't a machine available can according to Grayling have their assessment (it's not a medical) rescheduled until a recording machine becomes available.

I agree this is what's in writing but in reality this isn't happening, he could travel up there after being assured the equipments there and it not be, this is happening to so many people, me included...

Atos are very unprofessional, paperwork goes awol, my appointment was supposed to be scheduled to allow me to be back home for 3pm to get my daughters from school..

My appointment was booked for 3.05 pm miles away, I was forced to keep my kids off school and take them with me, the doctor then moaned at me for taking the kids and asked my 11 year old to look after her baby sister, I was told as it was the 3rd appointment my benefit would be stopped..

The previous attempts were because of trying to get it recorded...
I wasn't willing to have my benefit cancelled and put my house at risk...

Atos asked me to count backwards from 100 in 7's.. that was the main part of the assessment besides trying to trick me into saying I drink alcohol..
    "what do you drink?"
    "coke"
    "what about when you're out?"
    "coke.."
"I bet you drink some alcohol!!"
    "no..just coke.."
"no really, what do you drink when you're at the pub, you can't just drink coke.."

With respect how do you know that people are going to assessments and then being told there isn't the recording facilities after being assured there would be? Also how do you know that Atos are not carrying out pre-board checks as all the details of the Atos assessment including the PBC are sent to the DM for their final decision.

Any absence of documents would be detrimental to the DWP's case if the claimant were to appeal their decision. I've no doubt that there is the occasional lapse in procedure by Atos but whether it's endemic is moot.

I'd like to think it didn't but yes, yes it did.. I even have a witness, otherwise I'd think I dreamt it!!!

Strangely though, I never got anything to tell me if I passed or failed.. it was like it never happened - my ESA carried on as normal until I got another request to go for a medical 6 months after.. (Which I didn't go to as I moved on to JSA)

    QUOTE]

If I requested a recording and they say it's been booked but then tell me the day before it's not available how can they cancel my claim due to my non attendance? Surely I would be within my rights to then have another date when the recording will be available - or am I being naive here and have to realise that we probably don't have any rights?
