Help mobile phone insurance decline
Hi
I'm looking for some advice. Last week my mobile phone was stolen around 3am in a nightclub / late bar. My phone was by my side in my jacket zipped at all times ( jacket was hung over my chair). The pocket it was in was a small pocket the size of a mobile hence why I use it. I turned and noticed someone had unzipped it and pickpocketed my iphone4.
I was naturally gutted and reported it to bar staff and bouncers straight away, and to police and O2 the next morning.
I claimed my insurance but received a letter saying they had declined it as I hadn't taken reasonable precautions!!
Do I have grounds for appeal as I believe I did?
Advice welcome pleeaase

Ive just taken out 2 new phones from t-mobile a samsung galaxy s111 and a iphone 4s for my daughter. I accidentally dropped my phone last week after having it for only 3 weeks. I tried to make a claim for the broken screen and they are now telling me that when i took out the phone i declined the insurance for both the two phones. Now why would i take out two brand new phones with out any insurance especially when you know what teenagers are like? I payed money upfront because they said it was part of the insurance other wise i would of gone with another provider. I've got now proof of this conversation so i am stuffed, it looks like i will have to shell out 180.00 for a new screen. Help any advise ? so angry and disappointed been with T-mobile for years and this is how they treat me, they have informed me its too late to cancel the contract0

Lots of insurance will say you did not take due care when the phone is not on your person. If it had been in your trouser pocket then you would have been covered but a jacket pocket over the back of the chair will almost certainly not. Even putting it on the table in front of you is often refused because you would not put £100 in cash on the table.IT Consultant in the utilities industry specialising in the retail electricity market.

Unfortunately I don't think you're going to get anywhere on this. Putting the phone in your pocket and leaving it over a chair is not considered taking reasonable steps to protect it.
In hindsight you should have just said it was in your back trouser pocket and you had your pocket picked.
You could argue the toss with the insurers but I don't think they'll budge.
Did you acutally say the jacket was over the back of a chair??0 -

Secondly, was it not you who dropped your phone, not the daughter?
And finally, many people do take out brand new phones without any insurance. I think all insurances are very poor value for money, especially mobile ones.0 -
Why not claim on your house contents insurance?
I dropped my BB Torch in a flowerpot of water at work about 4 weeks ago.
Ruined instantly. Claimed through my house insurance. Whilst I have to say it took around 2 weeks to get a new phone, they picked up the old one, had it tested, called to say it couldn't be repaired and that I would get a brand new one, only problem they said, was that I couldn't have the same as I had, but had to have the latest new model Torch 9860!
Problem!, not from where I was sitting
So 2 weeks from dropping it I had a brand new upgraded phone, all for £50 excess.0 -
