Bought a phone from very.co.uk that overheating/faulty and need to know my rights!?

Hi, really need help with this!
I bought a phone from very on 18th June for my sisters birthday on the 9th July. It started playing up about1 week after buying it. It was vibrating, pulsating and doing things by itself.
I told them to call Sony to see what they advised, which they did. Sony advised my sister to take it into car phone warehouse to be looked at. A couple of days later my sister says its overheating and smells like burning. I told her to unplug it and switch it I off as it sounds dangerous and I would sort it with very.
Having looked online, the phone in question has a thread on the Sony website with 1500 replies with same issues.
So I decided to contact the retailer(this was 31 days after purchase)o get it exchanged.
Well very.co.uk have been really unhelpful, saying I need to contact the manufacturer myself and I had to give very.co.uk the imei code, which I did. Very then said they had contacted Sony and have no record of the call my sister made so I have to contact the manufacturer myself, report the problem again, so very.co.uk can be told if its faulty or not.
I told them its up to them to sort the issue out with the manufacturer, not me but they won't budge :-(
All I want is a replacement. So my questions are:
Do very.co.uk need to go through all this hassle of "proving" it's faulty through Sony, or am I within my rights to just return it for a replacement?
Also, are my statutory rights the same if I bought it in a credit account with very?

We are sorry to hear that the phone has become faulty.
We always advise our customers to call the helpline regarding faulty electrical goods as we are not technically trained to run through diagnostics.
Once the helpline have ran through diagnostics and the item is still not working as longs as it is within 28 days from being received they will provide a call reference number so we can verify this, we can replace the item.
If the item is over 28 days old a repair would be the next step.
