What should I do regarding this item?

Hi all.

I received it ver quickly which is the good point however on opening it I found a homemade CD with a label which was quite badly scratched. It did play however I was annoyed by the condition of the CD aswell as it being a copy ( I probably shoud have expected this but was being optimistic especially considering the price). I sent the seller this message:
Hi.
I received your CD this morning however the CD was scrathed considerably. Now it did play in my computer but I'm worried about the longevity of the CD because of it's condition. So I thought I should contact you first to see your response?

I then received this reply:
Thanks for your message. Unless the packaging was damaged the disc could not have been scratched before you played it because each disc is carefully checked personally by me before despatch. Now that you have played it there is no way of knowing how it got scratched. Presumably if you had noticed any scratches BEFORE playing it you would not have played it but you would have notified me immediately. I would certainly not play a disc myself which was scratched on arrival and I would make my complaint instantly rather than many hours later.
Out of anger I replied before coming here with:
The CD was scratched when I opened the packaging. The packaging was not damaged so it had to have been scratched before placing in the sleeve. There is no way it could have been inspected unless you consider it acceptable to post scratched CD's.

if it's a copy report them to FACT regarding copyright theft:

Also report him to ebay if you are unhappy, for making counterfeit items.It's BOUGHT (to Buy), not BROUGHT (to bring) AND you cannot be frauded, only DEfrauded.
Please do not buy animals from a pet store. Visit your local sanctuary or centre and give a good home to an unloved or abandoned animal.0 -
It's only a PDF file, copy it off of the CD onto your hard drive - then you won't need the CD it came on ... and it will open quicker.
You can always back it up onto a new CD/DVD if you have a CD/DVD writer, or use online storage like BT Vault or AOL X-Drive to keep a safe copy of it.0 -
Hardly counterfeit & FACT wont be interested as it not a film
Its a user manual in PDF downloaded from the manufacture's website & copied onto CD.
He can quite easily upload it to his own domain & let others download it0 -

You wanted the info you got the info - it plays and you can read it.
Copy it onto your desktop if your worried about future corruption of the data. As for the item being a "copy" are you sure this info was ever released by the manufacturer in CD/PDF format - it may only have been released as a printed book and the seller has scanned it into a digital format. Probably there is some copyright issues with this but hey how much does an original printed manual sell for?
A quick google suggets that DAIHATSU don't have their own download site for old manuals as there are companies selling them online - for more than you paid.
From a sellers point of view sounds like your just trying it on (although I'm sure your not) i.e you've admitted you can play it and you've got the info you paid for but now you want your money back - i.e you could have just copied it and then scratched it yourself. If you really want an unscratched CD to keep (and can't copy it yourself) ask for a replacement - which would suggest to the seller your genuine rather than just trying it on.0 -

The information is of dubious origins especially using the Daihatsu name and logo.
The information is not available from anywhere else that I could find and certainly not to download from the manufacturer.
I would have been happy with being sent a replacement but the seller did not offer that. Instead he launched into stating that it was inspected by him before being posted. This could not be true as it was scratched after removing the packaging.
I do not think it was unreasonable to try the CD after noticing the scratches but he thinks that this should lead to a conclusion to not play the CD. I did notify him within an hour of opening the package, yet he seems to think that this was not quick enough. I didn't open it until I got home from Uni.
If it cost less then I would accept it and get it copied but for £8 I think it should be in perfect condition.

Looking at the item it was quite evidently home made. He also makes it clear he won't be replacing or accepting refunds due to people printing off the item and then asking for refunds.
Given that you can read the manual, surely you've got what you paid for?0 -

OK you did a thorough google and discovered that the only place you could possibly obtain this information was from ebay.
You got a good price, the disc plays, - what exactly is your problem?
Don't want to be harsh but your sounding like a fool here pal "dubious origins" et al.

You didn't ask for a replacement did you? Why don't you just try asking for a replacement and if he doesn't agree - come back on here and we'll have him for you if that's what you want.0 -
Why dont you ask him nicely if he will be willing to refund, and if not start a paypal dispute (I think paypal would rule in your favor especially with the item being a copy).
