Red Castle Debt letter

Hi yesterday I got a letter from red castle claiming a debt some one called dolla finance or something like that, I've never had a loan at anything from anyone called dolla anything

I rang them and they said I own £445 to them when I told them I've never had any dealings with said company they said there also known as the money shop so I asked them to send the correct letter and signed proof they are now dealing with this

I do have a debt with the money shop which I pay £20 every month and have never missed

What rights do I have if any ? If they have broke our agreement and sold it on, do the new people have to prove I own the debt or can they just send letters to who ever they want

Please could some one advise me on this

Your creditors are entitled to sell a debt on, or to ask a debt collector to deal with the collection - so they haven't actually broken an agreement with you.

Yes you have a right to proof of the debt and proof they have a right to collect it.
The recommended way to deal with a letter like this is to write back with the prove it letter template and wait for them to provide you with proof.

    template in a sec.....

    ....
Letter when you know nothing about about the debt - AKA "Prove it" letter

Carry on paying the £20 a month, ask the debt sharks to produce a signed credit agreement and relevant paperwork to prove they own the debt.
Do not let them get a copy of your signature !

I have it in righting from the money shop to pay £20 per month
They claim they dont have this but i do (keep evrything)
And now this new company what more and are also ringing me at work

have you recieved any letters from the original creditor to tell you they have sold the debt?

Please do not speak the these people on the phone - refuse to go thru any security questions and calling you at work is a no no.

Yes I got letter from the money shop saying they are dealing with it from now, the thing I'm getting at is the letter from the debt recovery dose not match the company I have the debt with

I did refuse to talk to them at work but they keep calling how do I stop them before I get the sack then no one gets any money if that happened

They want more than the agreed amount I had with the money
I did not defolt on the agreement to pay £20 a month so I don't under stand why they sold it on

All the head ache is starting again for a debt I though was sorted out

When you ask them to send proof they should send something that proves that this is your debt - and that makes it clear the 2 trading names are the same company.

Even when you have an agreement in place a creditor will often sell the debt on. Debts are sold on to debt collectors in batches and yours will have been in a batch.

Regardless of how much money they want from you a month - you just need to be firm about how much you can afford. If you can only afford £20 a month then you'll have to offer that amount in writing (not yet, not til they have provided proof to you).

Along with the prove it letter, add in the text from the telephone harrasment template to tell them to stop calling you - http://forums.moneysavingexpert.com/showpost.php?p=11571485&postcount=4

Explains it. Doesn't mention owners on the CCA register. Just alternate trading names.

I believe you can ask them only to contact you via letter

Thanks I will right back and add in to the letter the bits you Recomend so what we are saying is the should have put "Dolla finance traiding as the money shop" ?

So I'm righting with the template letters saying I no nothing of any dolla debt and asking for a signed agreement that says I do have this debt

Once I get propper confirmation that they have it right and we are paying the right debt the make a offer or payment

    Is this right ?
