What do DA suggest regarding the 50/50 offer ?0

I'm going to speak to them about it tomorrow. I'm not really sure why Drive Assist are getting involved with the other insurer, surely it should be my insurer who deals with them?
Drive assist are the ones forking out the cash, not your insurer... Your vehicle has been repaired on a Credit Repair basis and you've hired on a Credit Hire basis... to put it simply it's big bucks they want from the third party insurer.0 -

Last week, we were contacted by Drive Assist who arranged the repairs on the car to let us know that the third party was now denying liability saying that my wife rolled backwards into him and he was willing to accept 50/50 liability.

Sounds like your Insurer sold your claim to Drive Assist who would have paid them circa £350 for the Credit Hire and £700 for the injury claim.
I assume you paid no excess for the car repairs.0 -
As other have said, you are not in a courtesy car but a hire car, your repairs arent being done for free but like the car are being done on credit.
Drive Assist are providing this credit to you and will look to recover the amount from the third party or their insurers. Needless to say, as with all credit, this is a very expensive way of doing things and so DA are going to be very happy for you to run up an excessive hire bill by letting you keep the car for weeks rather than you using your own vehicle until all the parts are in the workshop etc.
Obviously you can be unlucky but 6 weeks of being unfit to work due to injury and 7 weeks of repairs does not add up to a "not very hard" collision.
These types of arguments are not uncommon. By the sounds of it, the extent of damage and injury is almost certainly going to prove it isnt the 1mph collision that a rolling case would cause but a lot will come down to how strongly Drive Assist decide to fight rather than going for a 50/50 on the basis of differing versions of events0 -
My wife's Physio said that the worst whiplash cases occur during collisions between 4 and 8 mph!
I was quite shocked by that, but I guess at slower speeds you neck would be jolted forward, but not the rest of your body, so would be worse. If you were hit harder, you're whole body would move.
Either way, I've never heard of reverse whiplash, where you get it by rolling backwards into something!0 -
6-weeks with whiplash?! No wonder the third party are balking at it. Combined with drive assist bumping up the credit hire bill, they are going to fight to get out of this one as your talking ££££.Save £200 a month : [STRIKE]Oct[/STRIKE] Nov Dec Jan Feb Mar Apr0

Yes, but she's not claiming for loss of earnings, as there haven't been any.0

Hi, can our insurance company make us go through Drive Assist ? We are going through it at the mo with drive assist, believing they were part of our insurance. Having a battle with them at the moment. Thankyou.0

drive assist we have just had dealings with them deep scratches to one side of our car, they lent us a car...in total it took 6 weeks for them to repair our car....(did a good job thank goodness)
it is the communication within the drive assist company that delays things on 3 occasions we were told they were bringing our car back and then it got cancelled at last minute.....0
