    if your not accepting the authority then you dont have the authority to run a claim on behalf of somebody you dont have the authority from, not a dirty trick hahaha can tell you have financial backgrounds with your lack of clear talking

    I suggest you look up FSA complaints guidelines you plank. Of course, being a claims company representative, you wouldn't know FSA guidelines as you don't even know your own regulator's rules.

    You are a great advert for not using claims companies. So, unlike others here, I am quite happy that you keep posting as it shows others the sort of contempt and stupidity that the typical claims firm has.

    Something similar has happened to me. I got paid out after years of claiming directly from the bank. No mention of the claims company -CLAIMS FINANCIAL. 6 months later a letter from CF arrives saying that the bank were going to now pay out and could I stump up nearly 2 grand for all the hard work they did. The letters then went from black ink to red ink. They threatened to do a virtual kill on me if I didnt cough up. I didnt cough up. I did all the hard work for 2-3 years of constant badgering and the CF even emailed me a returned email marked 'unread'!! So, here I am in limbo. I asked CF to send me details of all the work they supposedly did on my behalf but they are asking £10 for them to do that!!

    I tried to cancel their services a few years back but they were going to charge me anyway. Another battle with another lot of thieving robbing bustards..

    My post 25 seems to have gone by without anyone having something similar happen to them? What I do now is anybodies guess. Please dont post judgmental and spiteful responses - that would not be beneficial - not just to me but other people with possibly similar experiences.

    I look forward to hearing from someone!

    You might have more luck with responses if you actually ask a question- you posted a statement, which is why no-one has responded.

    There are 2 points of view here.

    1. You could not tell the CMC, and hope that the bank do not find the letter of authority next time the CMC speaks to them. You're pulling a fast one on the CMC, but most people on here won't mind you doing that.

    2. You can tell the CMC and pay up as per your legally binding contract with the CMC.

    You will "probably" get away with not telling them, but "if" they do find out, and if you can't pay them because you've already got the new car :), then you may end up with them taking court action against you to recover their fees.

    Personally, as a risk averse accountant, I would tell them and cough up. That way I would know that there would/could never be any comeback on me. Not liking CMCs doesn't relieve you of the contract that you signed, and I wouldn't expect them to go easy on me if they discover that I have tried to pull a fast one.

    On a seperate note, have you checked the figures that they have sent you?

  • I hear what you are all saying and i agree with most of it. i run a claims company and although you guys seem to be against them i can say first hand that we have helped a lot of people get their money back. Yes you can do this yourself.. but you can also wash your own car but many go to the Albanian car wash up the road.. point is, we provide a service and yes for a fee which is a % of the win. For many who havent got the time or inclination to go through the process themselves they use us. we do not cold call or send unsolicited ads, we deal with people who come through our website.. customers who have wanted to do themselves, we have also sent them template letters, because they asked, and some of them have come back and still wanted us to do it. the claims company isnt the bad guy here. not nearly as much of the money would have been refunded back to customers if CMCs were not involved. we dont force you to use us, but we do study the banking code and the insurance code of conduct to precisely pin point how you were mis-sold and we build the complaint based on our research and why you should be refunded. We deal with the banks games that they play, how they try to fob complaints off, we fight your corner. please do not forget Lloyds being fined 120million for rejecting the complaints, the CMCs complained to the FCA and FOS and now Lloyds have to re-visit ALL rejected complaints. The banks can say to you whatever they will about not using companies like us, dont use them, you can do it yourself etc etc, thats because we are letting people know that they can claim. They're the ones that caused this scandal and again with packaged accounts, and now there is a new claim where they have been charging ridiculous amounts of commission when applying for a mortgage. We have learnt the rules and where you can claim because we are in the industry and we exist to help, if you wish to do it yourself that is absolutely fine, but jobs that this industry has created and the money refunded back to customers because of CMCs, you cant knock that.
    Anyway, good luck to you all, i hope you guys all get your claims upheld. yours peacefully :beer:
