Although I usually agree with your posts, this time I think the OP has gained some useful information and help - I certainly have. Also, if the seller has reported it stolen or lost, then there is definitely criminal action - twice over.

The reference to checkmend could prove invaluable and might give OP the opportunity to say "Unless you refund my money, it's the network who will be informed and they will block your current handset and the police will be informed"

What puzzles me is that in post #3 it was mentioned that the seller was contacted who seemed dis-interested in the matter, but the OP seems quite accepting of that almost as if they know the handset purchase was dodgy :o

Maybe, but post #5 clarifies that OP isn't just sitting back and knows what to do through the legal channels, but wonders if anyone here has a quicker fix.

I's a bit like squatters - we all know what the tortuous legal route is but sometimes there can be a quicker (legal) route if the squatters have made a blunder in gaining entry or if the property was inhabited.

I personally have never heard of a network blocking a handset when an account is in default. When you take out a new contract with a service provider the handset is separate from the account, you own the phone.

The only time I know they blacklist for none payment is for iPhones (because so many are being taken out and not paid for).

The other option is that the whole contact was taken out fraudulently (ID theft ect). It which case it's game over unless the seller had used their own info to sell it, which isn't that likely in most cases. . .
