Hi All, firstly sorry if I have posted this in the wrong forum.
I need advice with regards to the money shop....
I received a tax rebate and was going on holiday so decied to cash the cheque at the money shop.
Everything was fine until today, two months have passed since I cashed this cheque and I received a letter from the money shop stating I had broken my agreement of the "loan" with then and I had 10 days to contact before I would receive a door stop collection.
I called the money shop and they advised me they had lost the cheque so they hadn't cleared the cheque and said I owed them the money. The problem is it was for £1811 and I dont have this money. I have spoken to the inland revenue and they advised they need to check to see if the cheque was ever banked and then if not they can re issue but this can take upto 28 days.
So I then called the money shop back and they were very rude and said that I owed this money and it wasnt good enough!! Its not my fault they lost the cheque.
What can I do??

Wow, now that's a pickle indeed.
Trouble is, the crooks have probably already cashed it then it's gotten lost in their probably pi55 poor admin."We want the finest wines available to humanity, we want them here, and we want them now!"0 -
I just seem to be speaking to a brick wall when I talk to them! I have tried to explain its not my fault... can they really take this to a debt collection agency as its their fault not mine?0

Ok first thing you need to do is check that you have a receipt for the cheq from the money shop. ( they will have given you something to say that they have it or that you have signed it over to them.)
Then you need to contact them in writing if possible. Eithre hand deliver or recorded post and inform them that it is their negligence that this has happened and that in view of the fact that the chq was from a government body it may take some time for them to confirm that the chq has not been cashed and re-issue another.
Explain to them that you have had no other communication from them and where unaware of there error. The time frame that they have now given you is not fair and reasonable and you will take the matter further. You need to inform them that you also want any record of this removed from your credit file.
( Don't forget that the office or fair trading can revoke consumer credit licences also the fsa will investigate if needs be )
This should buy you enough time to get a cheq re-issued as if the fsa has to investigate it will cost them a lot more than a few days interest.
I have put links to office of fair trading and fsa. Although both bodies take a lot of flack there are actually very good at helping.

Why would you pay the cheque into The Money Shop. Do you not have a bank account of your own.I can afford anything that I want.

Point 3 - Sorry we disagree here, the terms and conditions of the Money shop will have a clause stating that if for any reason the cheque is not cleared OP will be liable.0 -

But that is not the case, the cheque is still valid and if cashed will clear.
Tell them where to shove their demands and you will have a replacement cheque with them within 28 days.0 -
They haven't got it though have they - we can argue the point as much as we like but OP is liable to pay the Money shop.

You are right the OP will still have to pay the money but given the fact the this is the first letter of notification that they have had that there is a problem the OP must be given time to repay. In this case it is compounded because it is a government body who will need to check before re-writing the chq.
I don't that that OP does not want to pay instead I think they are just worried about how long it will take and also the money shops attitude?Happiness, Health and Wealth in that order please!:A0
