So, you confirm that you are effectively saying that any seller can get out of selling an item even though the agreed price has been paid for it and the buyer still wants it by simply refunding the payment and then claiming his fees back?

And ebay are presumably quite happy with this situation?

They claim when you make the buy it now decision that you are entering a binding contract with the seller and yet happily collude when the seller refuses to honour the sale?

Ebay rules and attitude seem more and more bizarre by the day.

why do i feel like i'm being told off here?

as a seller i have never refused to sell something for the price stated and as a buyer i have never had a seller refuse to sell me something so i have not experienced this situation myself

i'm just telling you what the seller could possibly do

Having read this page it would seem that unless they have ommited something (and I find it hard to believe that they haven't), a seller can not only refuse to honour a transaction but get their FVF back and an RLC even if the buyer has paid (possibly more than once) simply be continually refunding their payments and closing the dispute after a refund and before the buyer has a chance to make another payment.

Not only will they fail to honour the contract, but they will receive no non performing seller strike, get their fees back and land the buyer with an unpaid item strike.

Can eaby really be so completely crazy?

I'm not telling you off, but you have provided information which, if correct, would imply that ebay have the most bizarre policies imaginable for dealing with sellers who do not honour a transaction.

i don't know if they could do that or not for definite as i have never been in that situation myself, i just said it could be possible

as frivolous fay has said they shouldn't be able to get their final value fees back as you have proof that you paid

if they do open an unpaid item dispute make sure you give them the paypal transaction id as proof that you paid

So from what you are saying here. ebay is a complete sham from the buyer's POV.

In a way, I guess you are right. All this talk of entering into a legally binding contract etc. is hogwash. eBay can not force anyone to sell anything if they do not want to sell it. By the same token, as a seller you are also extrememly exposed to scams. Read the posts here, know your ins and outs of PayPal rules, etc. and you'll soon be in a very good position to scam a good proportion of sellers.

The trouble is, eBay is in effect an automated system. They do not (and can not) work on an individual level. If they did, their fees would be so high that very few people would use them. Consequently they have a set of generalised rules that try to cover all circumstances, but fail miserably and as a result these can often be exploited.

Just composing a reply to the seller.

    So far I have:

I am prepared to send you another $9.5 to bring the postage paid up to the cost to post each item individualy.

If this is acceptable please let me know. Otherwise I will have no option but to open an Item Not Received report which would mean that you will lose your ebay fees.

Do you think it is a good idea to mention them losing their fees? I thought I would to do this in case they have not thought things through properly.

Anyone got any thoughts on this?
  • Ummm, even if they raise a non payment bidder ( if they refund ) you can select the I want to proceed with this sale option and basically they are stuck with the transaction in ebay. You could also point out to them that you have saved them a bit in paypal fees as they have only paid one initial $0.20 + %( or whatever it is for them ) rather than the mulitple amounts as you paid with one payment for all the items.
I too would not pay extra for postage after buying and paying for an item.

I was really hoping to get some feedback as to whether or not people thought it a good idea to mention that they will lose their ebay fees if they don't proceed.

I don't want it to seem that I'm threatening them, but I want to make sure they are actually aware of that as it should influence their decision.

Personally I wouldn't pay any extra on top of what I had won the auction for, unless whilst bidding the seller informed me the p+p was going to be hiked up, then I could have made a choice. IMO if a seller makes a mistake then they should absorb it, not demand the buyer coughs up after the auction has ended.
