    As soolin correctly pointed out, your description of the item is your downfall.

    It could well be a scam, but your not in any position to make such accusations. You have a choice, ask buyer to return item and you will refund them, or tell them to keep it and forget about it.

    I would advise to avoid such a scam happening again, that you advertise the product as being in "good condition", that would at the very least cover you from refunding buyers who are not satisfied with the condition it is in, because at the very least, the CD is playable.

    I value my 100% feedback and don't want to risk it for an item costing a few £££
    I made a mistake and when the buyer contacted me I offered a full refund + return postage to be given when I got the item back. I did stipulate 2nd class post. I did this twice and both times the buyers have given great feedback. They were also happy to cancell the transaction so I got my fees back.
    One of the items sold for more when I relisted it correctly so in fact I didn't loose out at all - but that was just luck. I was still happy to have given the refund + postage.

    aims for 2014 - grow more fruit and veg, declutter

    I think that you have decided that you want it back.

    If that is the case, then I would offer to pay for the return postage.

    Right or wrong, you have to be professional about requesting the return.

    If someone puts 'neary new' - i would expect it to be a few weeks old max.

    Some sellers put an item as new - then in the description put "i am selling this as new, as i have only wore it once" :eek:

    Its how you word it that can cause problems.

    I see your point but clothing and CDs are very different.

    Nearly new are both classed as used and would expect and got a much lower price.

    He got a very good deal in comparison to the new ones and the CD works perfectly

    I check everything before I send them and they were in top condition.

    I will follow ebay’s guidelines

    If you see scams everywhere, then perhaps selling online is not the best place to start.

    Collectors are obsessive, whether books, CDs or clothing, some people are fussy about condition. It wouldn't matter to me as long as it played, but then I'm not your buyer. He obviously feels he didn't get a bargain.

    The ball is in your court - you need to sort the situation out to your buyer's satisfaction if they are not happy, and stop trying to label them a scammer without proof just so you can feel good about holding them at arm's length.

    If something is used, then say it is used - this is what happens when you oversell something - you get unhappy buyers.

    I've been selling music professionally for 15 years and condition is opinion but everything.
    New/Mint - Sealed, nothing less. Rarely used.
    Like New/Near mint- Unsealed but usually unused beyond once, but absolutely no marks to case or anything and certainly not to cd. Most new CDs come in here if not sealed.
    Very good - Used but working and in tidy working condition.

    Slightly different with records.

    Personally I'd just refund, certainly not worth the time and effort.

    I get the general consensus is best to refund him but I am not trying to cheat anyone and obviously want a happy customer.

    I came on here to ask what to do as it has never happened to me before.

    I also have to protect myself as everyone I sell to could get a refund, possibly after copying it, simply over a difference of opinion about the condition.

    In my opinion, it is classified as nearly new and would accept it had I bought it at the price he paid. It is in the same condition as I bought it brand new (unsealed).

    I pointed out that it wasn't brand new/used and that brand new CDs are much more expensive. If he is a more serious collector wanting a perfect CD, there were/are new ones available at a much higher cost. I would have bought those instead of getting a used CD at a much lower price.

    As I said in another post, now I have read the replies from more experienced ebayers, I will do the right thing according to ebay's guidelines.

    I don't want to appear picky, but you need to stop concentrating on how much the CD was or is new, that has nothing at all to do with the scenario.

    I think this thread goes to the heart of what ebay is about or has become.

    If it's an auction site then the price paid bears no relation to condition unless flagrantly mis-described.

    We all see cases of people paying more than elsewhere because they get caught up in auction fever. But now they can merely say not as described and the seller has to refund if they decide they can buy cheaper elsewhere or don't like it.

    The majority of sales seem to be buy it now so it becomes a market site IHMO.
