Ebay - Difference of opinion

I have sold a CD along with many others that have hardly been played and sold as nearly new.

I check all my CDs, paperwork and covers to make sure they are in a decent playable condition as I like to provide a decent product.

Most of the CDs have been sold for far less than I paid but accept that is the way it is these days. This CD is the same.

I have had a buyer say he disagrees with my description and wants his money back. The CD is not faulty, he has a difference of opinion to what he considers to be nearly new. I state no refunds as people could copy and claim it isn't OK. Or they could damage it and claim it was how I sent it.

I emailed him back and stated this but he got nasty and accused me of fraud

Does this happen to anyone else on Ebay?

If you sold as nearly new then offer the buyer a full refund if he returns the item to you. I would expect that to be an unplayed CD that is perhaps not brand new but still as new- if it has been played then it should be 'very good' condition.

If it was a cheap CD you might prefer to refund the item cost and tell them to keep it rather than risk them not wanting to pay the return postage and leaving you a neg.

He admits the CD is fine, he is disagreeing about the condition which is upsetting as it is as good as new in my opinion.

He admitted that his opinion is an opinion

I am reluctant to just let him keep it as I feel he will still leave a negative feedback and I will be out of pocket. I also feel that whatever I do he will leave a negative.

If you handle it properly he is unlikely to leave poor feedback. Condition is extremely important especially to collectors. I sold in the book market for years and it is a difficult thing to master, but books, like CDs have a nearly new/as new category that implies it is new and unused but not mint for some reason, so for instance some ex shop books I bought I sold as 'as new' as they had been shelved in a book shop for a while and although brand new and unread were not 100% mint.

What is to stop someone copying and or possibly damaging an item, claiming it was me sending a bad quality item then wanting a refund.

I feel this Ebayer wants to cause trouble and whatever I do he will leave me negative feedback.

The CD is fine, he is disputing my description which he admits people can have a difference of opinion on.

Nobody can expect tip top condition for a low value item - I feel the price I charged is reasonable for it's condition.

Would I have to refund the postage as well?

There is nothing to stop buyers doing what you suggest except for good old fashioned morals. Likewise if you were the buyer we would be saying there is nothing to stop a seller misrepresenting the stated condition category (not condition, but category)- but again sellers would not do that. You described it as you honestly thought it should be described, but it was probably not in the correct condition category, there is no malice here on either side.

CDs sell cheaply, you were lucky to sell at all and buyer complaints rarely have any bearing on the value of the item. If he wants to return it then you must refund all his orginal payment including postage, you could even try a partial refund offer depending on the item cost- see if he is happy with that as a solution.

    How would this work?

He sends it back and I refund two lots of postage or let him keep it?

    Grading CDs is a nightmare.

The amount of people wanting to record and return is so low that its not worth mentioning. To be honest the cost of returning would put most scammers off due to the low cost of most CDs.

I have refunded twice in about 200 CD sales (and just told them to keep it) if that helps you.

    thank you

Sounds a good scam to me

Complain about the condition, accuse you of fraud to keep the CD.

The so and so will want his pound of flesh and want postage refunding as well.

What condition, does he think it is in? Have you asked him to grade it as he would if her were the one selling it?
That is the point I start at with what I sell when something is used.
Be polite when you reply and ask them to give their opinion. Now you sold something for £x as like new - I assume no scratches or damage to cover/artwork etc. If buyer comes back and states I think it only very good or just good. Offer partial refund only stating that this is a good will gesture that you are prepared to meet them halfway and leave it at that. Hopefully they will move on and then so can you. That's how I do Ebay when that crops up.

He thinks it should be graded Very Good

I feel the price he paid is reasonable for the quality

Also, how much, if any, postage do I refund?

If he returns it, then do I refund two sets of postage - the one I sent that he paid for and his return postage?
