My mum recently died leaving a small amount of money to myself, three brothers and one niece. My sister was left everything else moneywise. Mum always said we were all getting an equal share not including the niece who happens to be my sisters daughter. She also left a house to be shared 6 ways including my sisters daughter which was never what she told us. My sis denies ever seeing the will let alone helping to write it so when 75k went missing she said mum gifted it to her, my mum had alzheimers and would not have known what she was doing. After stealing her money she then sold the house to her daughter for half the market value who then sold it for full market value and lodging funds into an account in her daughters name presumably to turn heritable into moveable while still denying any knowledge of the will and its contents. I went to a lawyer and after a period of time she admitted she should not have sold the house to her daughter and agreed to put the money back in the pot. She still said the other money was a gift £60.000 from bank account. £10.000 POLICY CASHED IN AND PLACED IN ACCOUNT IN HER HUSBANDS NAME and a further £5000.00 that " SHE FORGOT ABOUT" after talking with lawyers they say it is not fraud because she was being left the money anyway and had put the house proceeds back. Surely if she did not know the contents of the will then she was stealing and commiting fraud can anyone help. Ps she also signed a legal court confirmation document stating the estate was worth 50k while knowing she had stashed away all of the afforementioned.

When was the will written, was it before the alzheimers?

  • Did'nt know it was a mobile phone section, not the forum i tried to get onto as u may have seen i am knew to this so i will keep a lid on what i really think of u!!
  • It was written before a comlete diagnosis but was still clear to everyone she had it.
The main thing was my sister was taking money she did not know was going to be hers. The lawyer has actually told me she is a cheating lying crook but can do nothing about it.

What you think of me is irrelevant, your Mum has passed away and all the offspring can do is fight over money? I know which ethics I would prefer, anyways get the mods to move the thread to the correct section. You may get more assistance there.

Don't know alot in these matters, but you could argue the will was created when she was not of sound mind and judgement, which could force the estate to be split equally among the immediate family.
