Buymobilephones.net disconection fee

Hi, I don't know if this is the right place to post but I was was hoping some one might be able to give me some advice.

I took out a contract with buymobilephones.net about 14 months ago (24 month contract with O2) and about 7 months ago I had a few problems with my bank and direct debits and I missed one month's payment for O2 and they disconected me for 3 days. I then paid the payment, once I realized that they had disconected me and I haven't missed a monthly payement since.

Then 3 days ago I recieved a letter from Buymobilephones.net to say that as I have left O2 that I now owe them the sum of £470.00. I have read there terms and conditions and it says that if a contract is disconected for any reason what so ever they have the right to charge a minimum of £240.00.

I could understand this if I had cancelled my contract early, but I'm still paying my contract and I don't owe anything on the contract.

Does anyone have any advice on this?

    Sounds like a mistake - I would contact O2 first and find out whats happened and then contact buymobilephones.net

    Technically, they may be correct as you were disconnected. Rea the exact wording again.

    If I were you, I would send them a copy of your most recent bill proving you are still connected and point out that, due to a bank error or changing banks, a DD payment was rejected, but as soon as it was spotted, you paid and were reconnected.

    O2 may have recalled their commission when you were disconnected and you may need to put in a little work to get it sorted out. As long as Buymobiles are a straight company and don't lose their sales commission, then you should be ok.

    If not, I would await their claim from the small claims court but I wouldn't pay.
