It is very kind of you to spend the time posting an answer to Brett but unfortunately Brett has a habit of posting constantly and asking the same questions over and over again.
He is a bit of a forum phenomenon (to say the least)
If you look back through his posts you will see that there is a theme.
Had it been anyone else posting then the answers would have been more constructive.There are three types of people in this world. Those who can count and those who can't.0 -

Dear Boss,
I want to take on a second job with X company doing X. This will not conflict with my role with (current firm) and priority will be given to (current firms shifts over ones assigned to me by X company.
Please confirm in writing your acceptance or otherwise of this.

I am sure what one person is doing will not be the same for any others as if caught working a 2nd job you can not say 'oh John has a 2nd job and you never knew about that'
Yes may think you have the right to a second job but not if the contract says you have to ask before you take one.
There may be a conflict of interest or it may affect your current one etc. Lots of reasons.0 -

Anyway, self appointed forum police aside, I'll chip in with my own thoughts.
The last placed I worked in had this clause in, but it was not enforced and seemed like it was just in there for historical reasons (ie a past HR jobsworth thought it was necessary to cover their but). A number of my colleagues openly had second incomes and in one case they went full time to the other job!!
OP could talk to other colleagues to see if they have a second job. Sound out if the HR department is particularly prescriptive in enforcement. In my current role HR are fairly easy going and would only step in if a problem arose from the situation.
And I guess a question for a lawyer is, how enforceable is this anyway? Don't we have a right to work? Is it similar to the unenforceable contracts that state you can't go and work for a competitor (which would kill a free employment market instantly if enforceable).
And finally, what is the nature of your role? In my position they would need a good reason to fire me as it would give them a big recruitment headache. I earn extra income in my own time and consider this my own business (well, I share with the tax man, but not work!). There would need to be a serious conflict of interest before it was worth them taking action. And I would also be highly valuable to my company's competitors, so it would be a bit silly of them to lose me over something like this if it had no real impact.
Perhaps it depends on what the second job is? A teacher friend of mine is paid to watch football matches at the weekend (talent scout), but I think there are some second jobs that would not be appropriate!!

My manager did say "it is ok being on an agency (when i was on one) as long as you don't call in sick to do agency shifts, like some staff have been known to do in the past"
However, it is not agency work I wish to do as with saving for a house deposit, and when I eventually come to buy, I would like it to be a permanent set hours (flexible around my current job I.e I give the days I can work) but set hours so I can use it to top up the qualifying income for a mortgage0 -
