    Also something worth mentioning; they employ new staff every year between October and November when they get busy in sales again
    rather than employing people directly for customer services, who want or don't mind working in customer services. It just doesn't make sense to me when it apparently costs them a shiny penny to train each person, what's the point of this?

    Their staff turn over has always been high, maybe this is the reason.

    It'll take time but we also have boards around the office showing our current stats red is bad green is good, I was green and there were a lot of people in red that month that aren't being moved any where.

    Let's just be clear about what you are saying. You are going to ask them for proof of what they have said. Then you are going to try to prove they are lying. And then you are going to tell them they are liars? That is certainly "rocking the boat". Are you really sure about this. If so, fine. But just be aware that they do not have to be reasonable, they just have to show you the door.

    And they may indeed be. But they can. It isn't against the law to discriminate in this way.

    I'm not going to directly tell them they're liars, I will seek advice once I have proof of them lying to see which direction to take I would be making a mistake otherwise.

    I was unaware it wasn't against the law to discriminate in the way I feel I'm being discriminated, thanks for pointing this out.

    Discrimination in law is only about things like race, gender, age and disability, and you have to show that the reason you are being treated like this is because of one of those things. Just be very careful here. I can see why you are upset, but you will be even more upset if you end up unemployed. I've never worked in a call centre, but everything I have heard about them suggests that they aren't the most sympathetic of employers and don't like "troublemakers".

    Tadevil, I'd think the business would take into account an employees quarter to date results, or their year to date results. They wouldn't rely on just one months figures. Really think this through carefully before you act on it.

    Maybe you should just keep your head down and be thankful you've still got a job. Why go rocking the boat? Look around for a new job while you're still employed, it's much better that way than being unemployed and looking.

    OP,

    If you want to submit a grievance, make sure you do it calmly and follow the firms grievance procedure. It will probably comply with the ACAS guidance (see their website) and involve an informal and a formal stage. You should find guidance on the formal letter and the process in the ACAS booklet (see website).

    You can only claim constructive dismissal if you resign and your employer has breached your terms of employment. This is unlikely since changing a shift pattern is almost certainly a flexibility condition in your contract.

    Just because you are "Green" and meet your targets does not mean that you cannot be in the lower quartile. Lower quartile is in relation to your fellow workers, it just means you sold less etc than over 75% of your colleagues.

    My view is that you have met your probation which was one way they could easily have got rid of you, so the move could be for positive reasons to help improve your performance. Personally I would keep quiet, be positive, ask about the reasons but try to be constructive about them. You at least have a job and proving that you have been distriminated against will not be easy in these circumstances.

    So I would not raise a grievance as you do not have a clear case and its one way of ensuring they release you before the 2 years. But if you think they are out to get you consider joining a union now.
