and although the biscuits in the hamper were crumbled in transit and there was a small piece of wicker broken off in transit she was happy with the item and thanked me for my patience.. ( She paid £99.00 plus postage)

but as far as I am concerned what I sent her was what I advertised.

She just sent me a picture. It is of a packet of 6 Oatcakes that are broken!! Thats it.

Is this as well as the crumbled biscuits and broken basket? At this point I am siding with the buyer.

    That's it? :( Good grief!

I think at this point, I would confirm that you have received one photo and ask for photos of any other problems.

I would say I'd give a full refund on return of the entire hamper & contents.
Don't forget to block this buyer from bidding again.

I have offered a full refund upon receipt of the hamper and contents returned signed for and insured postage. She however wants 50% of the price refunded and she keeps the basket and contents.
Regarding the poster who said they are siding with the buyer the biscuits and cake were only really enclosed as they had the jubilee label on them and I stated that the cake was out of date so not edible. Not sure how big the broken piece of wicker is ( have asked her as I cant tell from the photo)
This is the e-mail she sent when she received it

"The hamper arrived today and it had a broken piece off the basket and the biscuits were in crumbles. How ever i see you included the program and so i shall call it even and write you a nice review .There also were no cardboard .Thank you happy to have it we will use it carefully for special ocassions."

So what would you all think if someone then comes back with a dispute after she freely admitted in another e-mail that she miscalculated the amount of dollars it had cost and wanted money back.
As regards how much it cost the others I sold were similar price and I have had great feedback.

In other words, she's trying to get 50%/£50 off, after she made the commitment to purchase, on the basis of an allegedly damaged en route packet of 6 oatcakes.

If it were me, I'd stick to refund on return, ...though I'd be tempted to offer to reduce the price by the price of a packet of 6 oatcakes - or offer to send a replacement packet!

Other MSE users may suggest surrendering to her demands or going some way to surrendering to them, but bear in mind, there's nothing to stop her hammering your account with a negative and adverse DSRs after she's got what she wants. Her reference to writing a nice review is a subtle hint.

I'm going to guess this isn't exactly her first dispute and sometimes she's found she gets a result from those easy going UK sellers. I've known friends (occasional sellers) cave in to unreasonable demands: giving away items AND refunds ... and still get negative feedback claiming they're a scammer!

I asked her to return it for a refund and send it trackable and insured. She replied sarcastically that she wants £50.00 refund and keeps the item. She refuses to return it at her cost. I will wait a couple of days and then respond to the thread by saying I am offering full refund upon return of item.

Some more experienced buyers and sellers may wish to correct me here, but I don't think eBay will look kindly upon a situation where a seller has offered a full refund and the buyer both refuses to return an item and demands a 50% partial refund.

I don't think buyers can force partial refunds upon sellers - isn't it for the seller to offer this?

Looking at the worst case: A buyer leaving a negative, on the basis that a seller has refused to halve the price - after a sale, because the buyer demands it, sounds like it's on shaky ground to me.

i imagine if you phoned up ebay, explained to them the situation, they'd consider removing a neg left because you refused to give a partial refund when you were offering a full refund.

i bet the oatcakes have been eaten, that's why she doesn't want to return them
