In your appeal, can't you say that during the tel. conversation you took the application as far as you could before finding out you were not qualified/not experienced enough, and were advised not to take the application any further.I will be appealing in any case because I think it's harsh and as I mentioned before no one had explained to me that if I took the piece of paper from them and didn't apply I would face sanctions.
You'll have to appeal it bcause if you have to sign on again - the 6 month sanction will still be there!

Ok I signed off today and got my letter, my sanction is actually for 16 weeks and not 26. I was talking with the Jobcentre about appealing etc and they know I am starting my new job soon.
They told me that from 6 months of when the sanction was issued, the sanction will expire so to speak e.g. I have signed off now and I have a 16 week sanction. In 6 months time the sanction will no longer be there so if I , in March next year was to become unemployed again I wouldn't have to serve my current sanction. Can someone just confirm that this is correct for me?

I read on here somewhere that it's a breach of the Data Protection Act for an employer to say if someone applied for a job or not? I've also heard stories of people going for interviews that was followed up by the JCP but the employer said they didn't remember them, and considering some of the interviews I went for (for mundane jobs) that doesn't surprise me. I wonder how many people have been sanctioned like this? It's like fining you the equivalent of £1,136 for not applying for a job when they didn't even tell you there might be a sanction for it.
I think this also depends on the advisor you get, I had one who said it didn't matter and he'd have a nice little chat and just tick all the right boxes on the forms.0
