    Byatt, Fuddle (sorry dont know how to do multiple quotes) my DS got paid end Sept and had same tax code as Fuddle, no allowances, taxed on every penny. He contacted HMRC who said he should fill in a P46. I used to work in payroll a couple of years ago and this sounded wrong to me, as he had already been paid, but he did as HMRC said and contacted his employer's pay office, which is at a separate location from where he works, who apologised and said they would fill in a P46 on his behalf. Again sounded wrong to me as I thought employee had to sign it but assumed they knew what they were talking about.

    Today he has recieved his payslip for end of October along with a letter from his employer who said they were unable to submit the P46 as he had already been paid one lot of salary and that he should contact HMRC.

    So we phoned them and they said definately a P46 could only be used before the first pay day (even though in my first call to them they had told me the opposite) and that DS would need to get his employers tax ref, and call them back so they could deal with it over the phone.

    Makes me so mad that no one seems to care that my son earns a pittance and we have to jump through hoops to get what should be a simple operation put into effect. Damn good job he lives at home and we can help him out while it gets sorted. Plus it is his first job and he was looking forward so much to his first paypacket

    When I worked in a wages office I would not have dreamt of running the payroll until I was sure everything was properly done and this would have included making sure any new employee had either given me a P45 or filled in a P46

    Really no one should be put on pay roll without a P45 or P46 sadly now only HMRC can help. Call, you must. Best of British with that one!

    Righto, i'll call HMRC on Monday. Hopefully i'll get it sorted there and then. The thing that is annoying me is that I had no idea I had to submit a p46.

    I agree that individual people have to jump through hoops to get what is rightfully theirs... if in doubt, take their money! Sorry, I'm just cross at over even more hassle. DH has warned me that when he had to call HMRC to with changing his job and his work car that each time, during the week, he was waiting for 40 minutes. I can see I'm going to be hanging around for so long on Monday morning when I got through straight away this afternoon - over the same issue. Me to HMRC "I have had my first pay and have been taxed. I only earn £2000 per year at the most and I don't think I should have paid anything in tax." You must not have handed in your p45 or filled in a p46, whichever is relevant, go back to you employer to get the relevant paperwork to us"

    I didn't know it was too late for a p46 - and to be honest, why should I? Now I know I will push for further help but I'm cross.... can you tell!? :rotfl:

    Hope not to offend Byatt. I know you were an adviser. Like everything, there's some gooduns and some hopeless ones x

    edit.. oh great, I need my employers ref too? that's not on my payslip. I still have to phone the council then.

    Am I wrong for thinking that I just should not have to sort this out myself. I suppose it's my fault for not submitting a p46 in the first place. Going round in circles here lol
  • I am currently tucked up in bed in pj's and thick flufffy socks and my feet are still freezing. I had a pair of thermal tights and my slippers on all day (and other clothes of course).

    Mr VP and I have had a few words over the decorating. he has obviously got fed up with it taking up the whole week and as soon as he finished the last coat on the bedroom wall he put the furniture back without doing the glossing :mad: I then made the mistake of asking when the glossing would get done. I don't know what I was thinking really as he has never been one for doing a job properly/until completion which is why I usually do all of the decorating but that car accident last week has still left me with a painful back.

    The washing did dry today despite the cold weather, and I have even got it ironed :T. :THave got all of the towels and bedding washed ready to put out first thing. I caught Mr VP putting some of it in the TD but stopped him. If it is not fully dry when it comes back in tomorrow it can be finished off in the TD.

    Have got an extra shift tomorrow and an extra dy off on Monday then back to normal working hours which means tha there will not be enough hours left in the day and I will be back to lurking. I have enjoyed being able to keep up with everyone whilst I have been on leave. Off to have a mooch around the site before anyone else wants the pooter.

    DD2 loves her new room but is mad keen to get her posters up. I have said just one wall but I am sure it won't take long to spread to other walls.
    I am playing all of the right notes just not necessarily in the right order :D.

As I said I'm out of touch, I don't understand the logic of not accepting a P46 after being paid, as how else do the tax office know someone has started work with an employer. You're right the employee has to fill out part of it. It's annoying when big companies like councils don't do the job properly, but I'm not surprised. It sounds horrendous and I do feel for you all, I'll be starting SA soon, and I've already lost the will to live.

    Just tell them you've been told different things by different people including HMRC and could they please explain. Don't let them fob you off. You know now you should have been given a P46, which would have meant you would not pay tax, but no-one gave you one and now they have deducted tax on an OT code. Your employer should have given you a form, there's no reason why you would have known this.

    I miss the old days when you could get through to the tax office direct and even get a full name, and speak to the same person a week or so later.

    Don't worry though, they will be fine.

    Byatt I "think" it might be something to do with employers now having to file P46 forms via internet now - but could be wrong, all I know is it is a giant pain in the !!! :o (sorry am annoyed)

    Q. My new employee hasn't given me a P45 what do I do?

    A. If a new employee does not have a P45 you and your employee will need to complete a form P46 (PDF 177K). The P46 is the form to tell HMRC about an employee who does not have a P45.
    You should send the completed form P46 to your PAYE tax office on the first pay day. However if the employee has ticked either box A or B you do not need to send the form until their earnings reach the lower earning limit. Please note, from 6 April 2009 it is mandatory for your employee's date of birth and gender to be completed on the form. You will find more information about completing form P46 in Helpbook E13 Day to day Payroll - Taking on a new employee.
    You can send form P46 to us online using the Internet. You will find all the information you need on our online filing pages.

    Penalties for filing paper forms

    Unless you exempt from online filing, there are penalties for filing the P46 on paper. If you use form P46 to gather information from new employees, please ensure that they are aware not to send it to HMRC and that it must be returned to you.
    HMRC has produced a single page P46 form called P46 (Short) which can be used by the majority of employers, to gather information from new employees who do not give you a P45

    Good evening all - managed to sell a few bags at my craft fair, not as many as I'd have liked but still got enough clear profit for 1 meal at Centre Parcs so not too bad - and I didn't sell any of the ones I had earmarked for Christmas pressies so have not to remake as it were!

    The bad news is that I now have what DD calls a 'notty nose' which we've never been able to work out whether it is her unclear pronunciation for snotty or naughty - either way it's not good!! although I kind of like the thought of a naughty nose so I kind of hope it's that! As long as it clears up before Friday I don't care!

    Loved your image of the birds and the difference between the rich and less well off, sadly it is so true and going by that 99% of us are in this together but in the wrong group.

    I can understand your questioning the system Fuddle and yet they want to know more about us and yet do less to help us give them what they want/need to know and yet if we make a mistake we get fined and cannot claim it was a genuine error...

    It's funny isn't it VP, I can sometimes have socks on and find my feet are cold...other times they work...the same with my hands and the wearing of gloves...hope you soon feel warm and cosy...
