Your partner on the grounds of Incapacity Benefit can make a claim for Income Support, he will claim for himself and put you on the claim as the partner,
You should get couple rate I.S, couple Disablity Premium, less his IB.

I am taking it you have capital less then 16k, capital between 6k and 16k is taken into account as tariff Income £1 for every £250 in savings.

He will have to make the claim, he does this by ringing the countact centre
    Phone: 0800 0 55 66 88
and stating he wants to claim I.S on the grounds of his IB

This is the advice you need to follow - your partner needs to claim IS and you will be the partner on her claim. The contact centre will also advise you about HB & CTB when you call.

With my partner's illness going to the council house for a day whilst waiting to be seen could be quite awkward. Filling in the application forms is a much easier option.
There is definitely nothing on the incapacity form about back payments. I already owe a fair bit of money (fortunately only to friends and family) so would like to make sure I receive my back payments asap.

Well I've found the application form for HB and CB so I will get my partner to phone the contact centre below and make sure we have everything we need.

    Thanks for your help.

    Nevermind, we didn't know that...
Still, can anyone tell me where I can get the forms for HB and CB? Also, how do I go about claiming my back payments?

So how did she manage to pay the rent whilst at uni then if she didn't claim the HB?

You'll need to be careful about that.

They'll be looking at someone who has just completed a university course and as such is capable of doing some form of work.

As said, the ESA tests will be coming up fast so might be best to start planning for that as it can be a nightmare.

A little off topic, so forgive me, but just out of curiosity........

Since the OP wanted to go on JSA as he is fit for work what happens now as regards his ability to work as he will be on a joint Incapacity Benefit claim?

Will he still be required to attend job interviews etc?

    Seems very strange.

I was wondering about that too! It appears I will basically get benefits even though there is nothing wrong with me and won't have anyone checking up on me looking for work!

Fortunately I have no intention of sitting on benefits for the rest of my life - I went back to uni (and got a first!) in order to get a well paid job, and I still plan to do just that!

My partner is on incapacity not ESA so hopefully that will neatly side-step the health tests. To be honest my partner is actively looking for work but is limited in what she can do

Everyone on IB is being reassesed for ESA and probably sooner rather than later. If she is looking at being able to work then she may well not be able to get ESA.
