MSE News: EU mobile charges cut, with data roaming slashed

Hi Again all,
I wrote to Albion, quoting EU531/2012 and the roaming caps which would mean that the £9479 bill was based upon them charging £5/MB after the cap equating to £0.55 was enforced so should be much lower. I heard nothing for 2 months then got this reply:
I am advised that you are referring to something governed by consumer law not contract law however I am keen to resolve this in a way that takes in to account both parties needs therefore can I suggest we meet at your office next week and come to a mutually acceptable resolve.
Can anyone advise please?
Thanks.0 -

Tell them they are talking out of their !!!!, and that the regulations govern all roaming usage in the applicable countries.0 -
Thanks, I was thinking the same but I need to go back to them with with something more constructive

Can anyone tell me what, if any, reason they have for assuming contract law and/or our agreement is exempt?0 -
See the Mobile Roaming (European Communities) Regulations 2007 which are the UK's enactment of the EU directive. They contain detailed obligations on Ofcom for handling disputes. Can't you just let Albion take you to court? They would lose for sure.0

I suppose being a company sim makes it more complicated.====0 -
When I was following the implementation of roaming caps 10 years ago, business use was never an issue - the charges were to prevent consumers (as defined) being hit by high charges. It was not a across-the-board restriction that ALL mobile users benefited from, just consumers.
The supplier is correct in their interpretation, and as a business SIM, would not benefit from any of these caps.
As for the amount of data - an iPad loves connectivity, and will continuously update and download without user intervention whenever Mobile Data is not turned off. I certainly sympathise, but the OP is in a very awkward position as the charges are directly caused by inadvertent (mis)use of the technology.
Hopefully some waiver or other accommodation will be granted, but there will be nothing to be gained by involving OFCOM.0 -
If you are right (and I don't believe that you are), where in the UK legislation or the EU directive does it state that business customers are excluded? The supplier is correct in their interpretation, and as a business SIM, would not benefit from any of these caps.0 -

I would agree, in fact, I'm sure there is a preamble to the Euro Regs (the link you posted in post 17) that mention both consumer and business.====0 -
You're right. Business customers are mentioned in several paragraphs of the preamble. This seems to be yet more of Buzby's fabricated false information.I would agree, in fact, I'm sure there is a preamble to the Euro Regs (the link you posted in post 17) that mention both consumer and business.0
