BT infinity mis-sold?

Hi,

Following a recent call to BT with a billing query, it came to light that I was effectively mis-sold their highest BB package back in November 2011...

I was initially on the 10gb limit, but risked over-use each month so called them with the question:

"What is the next option up?"

To which the guy advised me about Infinity option 2. So I took this. My last call revealed that there is a middle option that is approx £12 a month cheaper that I was never told about.

I've basically, through ignorance and lack of info, paid BT £100 more than I should have ever needed to since November. :o

Anyone think I could have a case to get this back?

They just say that I agreed to it, and used it, so it is non-refundable.

Unfair.

(As an added note - having swapped me down to the lower option they have charged me a £25 activation fee to do so! - I've complained about this and got it credited next month. Yey. :))

    I appreciate there are now 3 options(10GB, 40GB, unlimited) however are you sure that there were 3 options when you applied?

    IIRC there were only 2 options Infinity 1 and Infinity 2 with the latter giving unlimited.

    Yes. The guy I spoke to confirmed this on the call.

    They say that they don't have to tell you ALL of the options, just advise the one that they may believe is best, but in the context of my question of "What's the next option up" they should have answered it directly apparently. And the answer SHOULD have been the 40gb one.

    All this info is freely available on the BT site, but you signed up without doing even the most basic research.
    But I'm amazed that they've agreed to downgrade you from the 18m FTTC contract you agreed to, because that implies that they accept some degree of mis-selling.
    No free lunch, and no free laptop ;)
