Its a private car park that has no physical barriers to non residents. Thats how I read it anyway.

If its a car park to which the public have access to, and it sounds like they do, its a public place. It therefore sounds like a non stop rtc.0 -

they have no measures in place to prevent unlawful entry to the private carparking section.I'm pretty sure they are liable as part of thier CSR to ensure people using their property's are protected.0

The fact there is no barrier doesn't matter. The car park is not part of the supermarket.

Perhaps you should read it again - its attached to a supermarket car park so you probably need to drive through the supermarket carpark to get to it. That section will be private. What makes it different? Different surfacing, lines, signs to name a few possibilities.
