    Its a private car park that has no physical barriers to non residents. Thats how I read it anyway.

    My drive way is private parking but has no physical barrier so its similar to that I guess.

    If its a car park to which the public have access to, and it sounds like they do, its a public place. It therefore sounds like a non stop rtc.

    No its not! There are loads of private car parks that anyway can drive into, it doesn't mean they are allowed to if its private property.

    they have no measures in place to prevent unlawful entry to the private carparking section.
    Have they offered secure parking with access only for tenants, or a carpark with signs stating residents only.
    I'm pretty sure they are liable as part of thier CSR to ensure people using their property's are protected.
    CSR. Corporate social responsiblity?. Do you think they are responsible for every local misdemeanor. You're clutching at straws.

    This I'd say:

    "it’s the residents carpark marked clearly for that purpose"

    The fact there is no barrier doesn't matter. The car park is not part of the supermarket.

    Perhaps you should read it again - its attached to a supermarket car park so you probably need to drive through the supermarket carpark to get to it. That section will be private. What makes it different? Different surfacing, lines, signs to name a few possibilities.

    You assume that but as yet the op has not provided any evidence of such. Google earth may help.
