Car Damage, who's liable

Matty,
A bit of a churlish reply, if youhad read the post properly, you will see that the carpark I refer to is not the“shoppers” carpark, it’s the residents carpark marked clearly for that purposeand as such, should have the necessary measure in place to prevent entry byshoppers. This was not the case, so they in my mind that would make them liabledue to lack of care to prevent unauthorised entry.
Anyhow thanks for the hostile response, not what I had anticipated!
I didn't say anywhere that it was a shoppers car park - that's irrelevant too. How do you know it was a shopper and not a visitor to a resident or otherwise?
And you are welcome, it wasn't a hostile response, I just find it incredibly hard to believe how they're responsible for someone else damaging your property.
Rather than insult everyone that's giving you the right answers and whine about people's tone, I'd get proper legal advice if you doubt us.0 -
Firstly to answer a reoccurring themealso mentioned by mattyprice4004,I have asked all of my neighbours re the damage and each has denied any wrongdoing and I know approximately the day and time it happened, so I’m 100% sureit was an unauthorised shopper I also have photographic evidence of non-residentsparking on a regular basis despite signage detailing that the area is residentsonly parking. In my original post I did say I could provide additional details onrequest.
Mattyprice4004 you wrote thefollowing as your open gambit “I fail to see how someone witheven an ounce of logic would assume the owner of a car park is responsiblebecause someone else damaged your property”. This I found to be offensive and if you speak toeveryone like this, then you’re in the wrong role my friend, perhaps you shouldrevert to trolling or similar as you appear to be a natural. With regards tothe right answers are you totally sure you are right? I seem to remember your figurehead giving a very verbose television interview detailing that noticesdetailing non responsibility for damage etc we’re a load of tosh and to bechallenged.
So going back to my original post I can here looking for advice, ideas and maybe even a little bit of sympathy, not to be insulted by a pompous, truculent ne’er-do-well, who knows jack !!!!, but likes the sound of his ownvoice or someone quoting psychobabble at me.
Finally re your final salvo “Ratherthan insult everyone that's giving you the right answers and whine aboutpeople's tone, I'd get proper legal advice if you doubt us”.
I didn’t insult anyone, simplywas astonished at the responses I received and replied accordingly, however Iam willing to accept the hostility of my final paragraph and want to thank youfor convincing me never to visit this site ever again and wish you everysuccess in the darkened room, which you no doubt occupy.
Cheers!

Is the private car park anything to do with Waitrose?0
-
Yes, Waitrose, built and own the block of executive flats above their store and built the carpark for the residents.0

There are a lot of threads on the parking forum. Basically anyone can park on your residential car park, and there is no come back.0

OP, if you had witnessed someone driving into your vehicle and had their details would you still think it was Waitrose fault. Would you be claiming off the driver or Waitrose?
If I drove into your car and you witnessed it, would you be happy for me to direct you to the Waitrose store manager and not give you my details.
As others have said, it is the person who drove into your car who is responsible for the damage0 -
OP what prevents the public from gaining access to the car park?0
