Can't understand why a poster would be WORRIED when they read the VCS case link:
http://www.dailymail.co.uk/news/article-2150551/Thousands-beat-parking-fines-judge-tackles-766k-Mr-Clampit-landmark-penalty-claim-case.html
For gawd's sake it says ''a judge ruled that one firm did not have the power to pursue a motorist for an unpaid penalty.''
And VCS also fell foul of a judge in the VCS -v- HMRC tax appeal case in May as well, which was a higher Court and so the decision is binding:
http://www.bailii.org/uk/cases/UKUT/TCC/2012/130b.html
''Conclusions
We have found, firstly, that VCS had no right to claim damages in trespass against motorists who parked in breach of the relevant restrictions, and accordingly that the penalty charges did not constitute, in VCS’s hands, such damages. Secondly, we have found that there was no contract between VCS and the motorist, and that accordingly the penalty charges could not constitute damages for breach of such a contract.
In our view the only relevant contract to which VCS is a party is that between VCS and the client.''

Hi all
my ticket situation is on going from June this year with euro car parks I have not acknowledged any of the correspondences hey have sent, and today they have rang my mobile and I answered it BUT I'm now worried that they can say that I have acknowledged the ticket??? Anybody had this happen to them???
I should of asked how they got hold of my mobile number!
Thanks0 -
No, you haven't acknowledged the ticket.
If they ring again, tell them the debt is denied, and any further calls received will be treated as harassment and action may be taken in accrodance with the Protection from Harassment Act 1997. Then end the call.Je Suis Cecil.0 -
It doesn't really matter Faye. I mean how do they know it was you and not an imposter that spoke to them? For all they know, you may have lost that telephone and the sim card the day before.
Bottom line: you legally owe not ONE penny to Euro Car Parks or their agents. They CANNOT successfully defeat you in court because their demand is unlawful, so if they ring again - place the phone by your music system and hit them with something at full blast.0
