Got a dilemma, only used the site a couple of times so im hoping someone can help me out, because i dont know where i stand.
On june 17th I did a o2 upgrade through buymobilephones.net, the phone was delivered a couple of days later, it worked fine, everything was all good, this morning, i went to use my phone and it wouldnt work, so I contacted o2 and they informed me that I was now in actual fact a pay as you go customer, and not on a pay monthly contract.
I asked why this was because I upgraded a week ago, and they stated we have recieved no order to upgrade your contract.
So i contacted buymobilephones.net, they werent paticularly great, but they stated that the upgrade was requested and processed and that everything was fine and if the phone didnt work i was to discuss that with o2 directly.
Then I used the online chat service through o2 and basically asked them the same thing, they again stated that i was no longer a pay monthly customer, i now have an email transcript with this on as well.
Where do i stand in all this, because the only way i could resolve the matter was I had to take out a new contract with o2 so i could have a working mobile phone. I feel like ive got a phone for nothing because ive tried discussing it with both parties and neither want to help and seem to think ive done nothing wrong, on the other hand i feel like i know im doing something wrong but i cant correct it either despite best efforts.
Any help is appreciated

As I understand it the phone comes from buymobilephones and the cotract from O2 so it should be buymobilephones that deal with the faulty phone. Failing that I guess provided you've got proof of purchase (i.e, your upgrade paperwork) you could go direct to the manufacturer?
But one thing I dont get is if you are now a PAYG customer and presumably haven't topped up your credit seeing as you know nothing about it, how have you been able to use the phone?0 -

Sorry if im not explaining myself very clearly, basically o2 terminated my upgrade contract today as it was the end of my previous contract, the upgrade went through, and o2 terminated it today, so i signed up for a 2 year contract with buymobilephones.net which was processed for o2 to cancel it today, i now have a spanking new phone from buymobilephones.net but the contract was terminated after 9 days by o2 due to there words "not having an upgrade order"0 -

Give it some time, and see if they come back to you about the contract not being set up correctly.0 -

Yeah im hoping thats the case, but in buymobilephones.net t&c's it states early termination can be a £240 charge, but i never did anything wrong, lol! Do o2 give out that kind of information? surely its against the data protection act....0 -

It could be they realise at a later date- that would be my main concern with that.
I know its probably going to feel like your ruining a very good free phone but get things written on paper so if they do try to chase for the handset or early termination of the contract you have it written down to say they terminated the contract and not you and that you are not liable- get that from 02 (Just ask for written confirmation from them regarding this contract being ended early).
Then I'd make sure the online store were aware and didn't require anything- perhaps send them/email them a copy.
Then I'd make my bank aware the contract had ended and so end the direct debit so they can't carry on taking money when they have said they wont. And if I were really worried an additional £XXX could be taken on a whim from the company (I would worry about this through some technical error!) I'd also ask for a new account number ! -But only after all of the above had been done. And keep everything written down in a file0 -

Agreed. An upgrade is just a contract recommitment, so if you've avoided that but got the phone, then that will be great. If BMP try charging you a penalty, then you tell them they should have given you an upgrade.
If you can keep the phone without the upgrade, take a look at GiffGaff as they use O2's physical network but are cheaper.0 -
I would be careful as at some point in the future I'm sure buymobilephones will be expecting a commission payment from O2 which presumably they wont get as they haven't set up a contract. At that point I'd expect them to look into this more closely.
You know that the phone technically isn't due to you as there is no contract so I would expect them to either ask for it back or send you a bill for it at some point in the future. Might not happen but could be an unpleasant surprise if it does.
I admit to being pessimistic about these sort of things but that tends to result in no nasty surprises in the future.0
