    No problem with being on the electoral roll - but opt for the 'edited' version. That should stillbe visible to credit agengies and so improve your file but your details can't be sold to all and sundry by your council.

    The first thing to do with MacHall is to send a prove-it letter. Not all debts are consumer credit agreements, and it's debateable whether you should be requesting this on a debt that might not even be yours.

    A cca request should be accompanied by £1 and there's no need to do this with a prove-it.

    Well after lots of tooing and froing with them they have finally sent us a letter stating:

    "With reference to you previous requests for copies of the original credit agreement for this account.
    After leasing with Barclay card in a effort to obtain this document we have been advised that it is no longer available due to the length of time since the account was opened with you.

    We are closing your account"

    So with the above in mined am i able to claim back any money my wife has given them and if so is there a standard template letter i could use.

    If you get money out of MH, you'll be a hero on this site! Please give it a go.

    The first thing is to get a list together of payment amounts and dates they were made. You could ask MH for this (even do a Subject Access Request) but they may not be helpful.

    You will be reclaiming the sums plus 8% interest and I have an excel spreadsheet that I used to use to reclaim bank charges that will do the job nicely. I think I got it off this site many years ago.

    Then you would write to MH demanding that sum.

    They have already sent me a statement of account of all payment they have had from my wife in a earlier letter stating that this was prof that she had entered in to an agreement with them for repayments.

    the spreadsheet sounds like a nice tool to have will pm you my email address if i cant find it.

    What i will also need is some form of wording that sounds like i know what i am on about.

  • Don't forget the cost of phone calls and time in writing to them ie: £5 per call and £15 per letter. ;)
