    It sounds like they think your wife is a "soft touch" and will do everything to pay the full amount back asap. That's what it feels like anyway. They never send the boys round when they are dealing with more shall I say "combative" victims ha ha!

    There is one important question though:

    - What type of debt is it for? You mention your wife has a perfect credit score so the initial default obviously didn't show. That means it's probably not a default associated with banking or credit etc...

    Bringing me onto the next bit...

    If the debt is for something silly like a parking fine or some minor mishap with a payment then I would tell them to sod off! My hunch is that the debt is slightly unenforceable and they might be trading on your wife to get it paid.

    If that's the case send em prove it letter and punish them if they harass you! You don't need to pay anything :D

    Or if there ever was a default then with Muckraking Hall it's likely so old that the default has expired from CRA files.

    The only thing we can come up with is its some old catalog fiasco she did with here sister back in 98.

    The plot thickens after several stern words about if you ever receive a call form these guys again and don't pass them on to me type conversation shes just told me about another one called Fredricksons working on behalf of Lowell Financial :eek:

    then the debt is most likely statute barred and making these payments has not re-started it, it can not be re-started.
    my honest advice is cancel payments, even if you have to close the account and IGNORE them until they put up or shut up.

    In the mean time send a SAR and £10 and see if they have a signed credit agreement, if they dont sue them for all the money back.

    No point buggering around with SARs or credit agreements until you know what the debt was for and that it's not statute barred.

    Quite often you will find these companies either work together and/or they are part of the same entity. I have experience of Lowell working on behalf of all sorts of companies so it's possible once one company discovered your wife paying for things then it's basically open season for the others within the same group or sharing that info.

    The most important thing here is so end the payments and tell em to sod off. Then you can go about stopping them contacting you and getting your phone number ex directory (It's usually how they get your details in the first place) so they can't pester you in the future. It's also worth adding your numbers to TPS too and if your past bothering with credit anymore apply to go on electoral role but the non public version. Be careful with that last one however! It can damage your profile not being openly registered on the public role.
  • Mackenzie Hall are a debt collections company who buy old debts from the original debtors. They often pay a tiny amount for the debt and stand to gain a packet if they can get the debt back. They use various dodgy and unethical ways of collecting the debt eg threats which they are not entitled to carry out under the law. If you get a letter from them the first thing you should do is to to get a copy of the original credit agreement from them. IF THEY DO NOT HAVE A COPY OF THE ORIGINAL CREDIT AGREEMENT SIGNED AND DATED BY YOU (check it is signed by you) THEY CANNOT LEGALLY PURSUE THE DEBT. Any debt for which you did not sign a credit agreement does not have to be paid back if you are unable to do so. This outfit have been known to try to get back debts already paid, debts written off and use methods which are unlawful eg constant phone calls, threats to visit your house (illegal) etc. Do not give into their threats. get advice first from the Citizens Advice Bureau or National Debtline who are a fantastic and underfunded organisation. When I became ill and was unable to work they sorted out the debt I had got into. And do not be guilt tripped by the "debt free and proud" brigade online. These people are often representatives from debt agencies who want you to feel guilty about getting into debt when many of us are in that situation due to circumstances beyond out control. Remember the biggest debtors are the bankers who are effectively financial criminals who got off scott free and wealthy tax dodgers.
