Not Mackenzie Hall Again

Well whilst i am siting at my computer trying to sort out my credit history my wife comes down stairs all distraught after receiving a phone call for Mackenzie Hall.

Basically she responded to a phone message from them last year (unbeknown to me) and agreed to a £5 per month repayment plan debited from her debit card monthly.

She says the phone call went like this..........

MH - "Mrs
you have defaulted on our agreement and you now need to pay the balance in full".

Wife - "How can i have defaulted you take the money automatically every month of my debit card".

MH - "well our records show you missed a payments in Aug 2011 and Jan 2012".

Wife is now frantically logging on to here online banking

Wife - " i am looking at my bank statement now and it says you took 2 payment in July 2011 and 2 payments December 2011".

MH - " So you missed the payments then as your agreement is for you to pay on the 15th of every month".

Wife - " but you Take it automatically and you have taken the payment twice in the months before".

MH - "its not our responsibility to monitor when your payments are taken and if you pay twice in one month it only counts as that months payment".

Wife - "but" rudely interrupted but MH "look Mrs
i am not going to discuss this with you any more i am just calling to inform you that if you don't pay the balance in full now we are sending round the door step collection department to take goods or assets to the value of the outstanding balance" they then put down the phone.

Wife tries calling them back several times but is mete buy the same response

MH - "are you calling to pay the outstanding balance"
Wife - "no i need to discuss this with you"
MH - "sorry Mrs
But the time for discussion has passed it is now being passed to door step collections" and then they put the phone done.

So i try to call them

ME - "hello i need to discus account number M
with you"

MH - "i am sorry but due to the dater protection act we cannot discuss this mater with you unless the account holder gives us permission"

ME - "but the account holder is next to me and is willing to confirm that i can discuss this with you"

MH - "sorry but we can only except this authorization in writing blah blah blah Would you you like to pay the balance with us now"

Me - "NO but i thought you couldn't discuss this with me" MH then put down phone


My question is what can i do about the scumbags as my wife's credit history is spotless on all 3 CRA,
I know they have no legal powers to enter and take goods without a CCj or court order and then it can only be the local court appointed bailiff that comes.

Should i just tell my wife to tell them to go fourth and multiply and see you in court next time they call.

    It's been established that you can cancel Recurring Payments from a debit card. So do so.

    Recurring Payments

    Then you need them to prove that you owe this and that the debt is not statute barred. As this is MH there's every chance there is something dodgy about it.

    You'll also need to make it clear that you're not going to discuss this on the phone - everything in writing.

    If it turns out to be genuine, and not statute barred, either pay by standing order in future or negotiate a full & final settlement, bearing in mind that whatever it is they probably only paid 5p in the £ for it.

    If anyone turns up, tell them to go away. They have no rights without a court order and they probably won't get one based on you actually being up to date with payments :)

    Make sure you cancel the payments x

    Definately, they chased my hubby last year for a debt that he had sorted years ago, luckily I had heard about these total scumbags and wrote them a nice letter telling them to foxtrot oscar. They wrote back apologising for harrassing us and saying they had made a mistake!!!!!!! They are just chancers and think my threataning to send the boys round they will scare your wife. Honestly, write to them and tell them you will be reporting them to the police for harrassment and to the FO.

    Wife is on the phone now to bank requesting them to stop all future payments to them and asking them to claim back any payments already made.

    I have just printed out the prove it letter and popped in a cheque for £1 and am of to the post office with it sending it recorded signed for.

    Also

    Write a letter of complaint t McHall.

    When you got the fob off letter back, complain to the Financial Ombudsman.

    Even if you don't get anywhere it costs them money.

    You wont get all payments back
    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.
