Thank you for everyone's advice. After sending skullcandy some links to details on distance selling they referred the issue to their legal department in the US.
They sent me an email today saying
We got approval from legal to accept the UK law.
You can send back your item to the address I gave you in my first emails, as soon as it reaches us we will execute a full refund.
It took a lot of emails but success in the end.
Many thanks.0 -
It's the ".co" and the ".uk", which at least implies a UK presence.
So, an address something like condescending-gits.co.uk would imply that the condescending gits were located in the UK.
But if the condescending gits aren't located in the UK, despite implying that they were, wotcha gonna do about it? They still can't be subjected to UK law, whatever they implied.Je suis Charlie.0 -

Im glad you got a result but whoever works for them and sent that email out needs shooting."If you no longer go for a gap, you are no longer a racing driver" - Ayrton Senna0 -

But yes, it's only ltd.uk and plc.uk that are checked as bona-fide UK companies.
Anyway, in this case the company decided that they would go with it.
(Incidentally, OP, TK-Maxx are selling SkullCandy headphones at the moment.)0 -
HMV sell SkullCandy as well and I believe you can try them in some stores.0

If it was an online / mail order there must have been a card used. If this was the case is not the card co / your bank (who are running the card) also liable?Do you want your money back, and a bit more, search for 'money claim online' - They don't like it up 'em Captain Mainwaring0
