Hi, UPDATE - Case has now been passed to Adjudicator. As I was authorised person to deal on behalf of my nephew they sent by post and emailed me questionnair for my nephew to complete. 22 questions to answer but some of them are:-

1). Did you keep any form of record of your PIN? if you did, please explain how you recorded it and where you kept the record.

2). If you did not keep a record of your PIN, please tell me how you were able to remember it?

3). Was your PIN a memorable number? example a special date?

4). What was your source of cash for the week(s) of the disputed transactions? Where possible, please provide supporting evidence (such as copies of statement for other bank account, showing cash withdrawls you made during the period)

5). Where were you at the time of disputed transaction? Where possible provide evidence example a employer, friend, spending on other cards at the same time.

Now his PIN number was set as part of his Date of Birth - Will that go against him? Question 4 Source of cash for the week - He lives with parents so pocket money was provided by them. He has no bank accounts.

    Thanks
    MS

All you can do is answer honestly and see what they say.

You've already written out the answer to Q4, just copy that sentence into your reply to them.

Given that he may well have already told HSBC this info....

Do not even think of putting something else.

You really need to sit down with him and thrash this out.
Any diffrence between what you enter now and the info HSBC have been told. Is not going to help your case at all.

    Thanks for your replies.

Definitely will be honest when completed the questions. But I just thought taking digits from his DOB and setting up his pin, he may have gone against his bank terms and conditions.

I will update once I get further correspondence from FSA.

Frankly, it isn't the most sensible thing to do, but it's history now, all you can do is present the facts and hope. Trying to change a story now will only harm his case.

    Really????

He only had HSBC account thats it which he stopped using now. He has no other bank account. Due to his limited credit history he finding hard to open up an account both Halifax and Santander has rejected him. Ihave seen his credit report and nothing on it apart from HSBC account and afew credit searches. He might apply for a savings or a basic account.

I suspect he'll find it very difficult to get another account anywhere. There's possibly a CIFAS marker against him.

Thats what I thought previously i got hold of hid experian/equifax credit report plus report from N Hunter. No CIFAS warning showing. If it was we would have challenged it.v

If he has no adverse entries on his CRA files and if you are positive that there is no CIFAS marker, it sounds rather unlikely that Halifax and Santander would turn him down.

    Something doesn't add up.

Is he on the ER? Does he fill in the application forms correctly? How did he apply - online or in Branch?
