Thank you cabbage that is interesting about the code of conduct. I will look into it, im sure the mortgage lenders could do more even if just for a couple of months until things go well for us again.0

It does if you just put both your incomes as zero, and say neither of you is working. Then at section 6 say you intend to apply for income related JSA. Is this the type of thing could be answered on the new cab board thread? at least while you wait for an appointment with them, you could try it, cab are supposed to answer on there.

Would the partner get income based JSA if tax credits are being awarded? I am not sure that they would and I thnk this is the question the OP is asking.

They could get child tax credit and income related JSA. If they stopped getting WTC, they would get income related JSA and probably smi assuming their mortgage qualifies. (But I'm not sure how stopping a WTC claim works).
Getting WTC doesnt disqualify someone from getting income related JSA, but it is taken into account in full in assessing how much JSA they might get.
All of these benefits will be assessed on their income as a couple.0 -
Feelibgworried, I think you have fallen foul of what I did when I had to go onto benefits 4 years ago. I asked to have the mortgage put into interest only, but they stated that, on paper at least, I could afford the mortgage (I think this is what they mean by affordability with you). I had been left with debt by my ex and had made arrangements with the companies to pay it off- abbey basically told me to default on the debts and pay the mortgage. If part of your problem is paying debt then you may have to consider taking some drastic action with that. I was lucky that I was able to manage after some very strict budgeting.Tomorrow is always fresh, with no mistakes in it!0
