DFS help

Hi,

I walked into a DFS and ordered a sofa on finance a week ago today, I have to call back and confirm sizes but I had 2nd thoughts and called up on Thursday to cancel the sofa due to various circumstances. The manager told me this was not possible and if it was it'd cost me upwards of £400 (25% of the sofas price), when I said I would't confirm the sizing he told me the manufacture 'would go ahead and make the sofa that I sat on, said I liked and wanted but would confirm sizing later'.

I looked into older posts on this forum and elsewhere online and took several tips and used my 14 day cooling off period with the finance company to cancel the finance and I do not have the means to currently pay nor do I for any time in the foreseeable future.

The flat I was initially buying the sofa for has fallen through so I would no longer be in that flat nor my current flat as my lease is up next month.

I've not paid any deposit with DFS and I have still to confirm sizing for the sofa, if I don't confirm sizing will the contract just sit there waiting for one party to act? And even if hypothetically I was in the flat for delivery can I accept something I didn't confirm if they go ahead and make the sofa the manager remarked? When it's all said and done, am I still liable for this contract considering the finance is no longer there (although I accept that's through my doing) and that's what I was signing for and agreeing?

    I don't believe you can cancel without losing your deposit as you did this in the shop

    The cooling off period relates to people who come to you or on the phone.

    You may be better off trying to negotiate with DFS to get something you DO want to the same value.

    Oh - and don't use DFS

    Speak to your local trading standards officer and they will clarify the process. I do not believe that they would have started making your order without the measurements or otherwise.

    I suspect that Robatwork is right and you can't cancel. Why order something if you don't have the money for it (or a definite flat to live in)?

    Not necessarily, read the contract you signed and as suggested talk to your local trading standards.

    get an appointment at your local CAB. They shouild also be able to advise you. It may be possible for them to write a letter for you explaining your circumstances for you to plead your case.

    I bought a sofa from DFS part deposit (£600 cash) the rest to go on finance. This was to purchase a display suite ready for delivery as soon as finance had been confirmed. This was on a Friday. I changed my mind and went in on the Monday spoke to the original salesman who cancelled my order..begrudgungly butbwithout argument. It took 2weeks for my cash refund to go into my account but I got it without any problems.
  • I spoke with Citizens Advice last week who told me since I hadn't confirmed anything and no longer had finance I should have no problems cancelling, I'm awaiting the draft letter I sent over to them being sent back before I do what they told me next and that's send a recorded delivery letter with my intention to walk away from the deal.

    In the mean time I'm looking for further advice and tips from anyone who has had similar expereinces or anyone with further knowledge in that department.
