PCN I ignored- was it a bad move help?

    It also says £25 admin fee, and you say they've charged you £30??

    But what you've received is a "speculative invoice" from a private company. I see no mention of these.

    So, just to clarify, the OP:

    (i) contacts their credit card company and tells them that the £30 admin charge is outwith the terms agreed with DriveAssist because the penalty charge isn't a charge, it's a speculative invoice, which DriveAssist should've simply ignored. The £30 charge by DriveAssist is therefore erroneous or fraudulent, and the CC company is obliged to refund it.

    (ii) writes to DriveAssist to explain the difference between a charge and a speculative invoice, and pointing out that any and all charges levied by DriveAssist in this regard will be reclaimed from the credit card company as unauthorised payments.

    Does that cover it?

    sorry- yes that covers it and your response has also clarified a few things for me which i have included in my letter i.e speculative invoices are not covered under their terms.

    I had already half drafted the letter!

    Emailed this on tuesday and still not heard anything back...how long do you think I should give them or should I just leave it??

    If you leave it you will get charged £30 every time they get a letter! And these scammers send LOADS of letters (see the third from top thread)!

    What you should do as well is immediately write to Roxburghe and say 'your letter has been passed to me as I was the hirer of the car at that time. Please explain the charge you claim I am responsible for'.

    Give them your name (misspelt, maybe) and address (so they write to you in future, hopefully). Do not sign with your normal signature (never give a scammer your real signature, they do not need it, just a squiggle will do). Do not say you were driving the car, do not talk about the situation that day in the car park. It's not an appeal, it's a very basic letter to hook Roxburghe in your direction.

    In fact, with a hire car we always advise that you should NEVER ignore a fake PCN. You should have read up specifically on lease/hire cases on here as it's been covered before. If you had written up front they may never have written to the hire company. You MUST be proactive now unless you want £30 charged every month - if that happens I would sue the hire company.
