It looks like another case of an organisation wrongly trying to use the DPA to prevent someone accessing information to which they are entitled.
Section 55 specifically refers to "personal data" which is data from which a living person can be identified, which isn't possible by simply using the askmid site.
Even if you could obtain a name, Section 55 allows this if:that the obtaining, disclosing or procuring—
(i)was necessary for the purpose of preventing or
detecting crime,
or
(d)that in the particular circumstances the obtaining, disclosing or procuring was justified as being in the public interest.
and my opinion (a legally untrained opinion) would be that if a car wasn't displaying a valid tax disc then seeing if it had insurance in place may well be classed as preventing crime and would be in the public interest.0 -

One of the tax discs was 30/04/12. Looked in disrepair as well, shame I didn't get the reg.Mortgage free I: 8th December 2009!

Why do you care if a car in a car park isnt taxed ??? Different if it was on road outside your house .. Who owns the car parks ??

I must say OP, although I take issue with people driving without tax and insurance, I don't go round car parks actively checking everyone's tax discs.

Just because it's not showing a current tax disk doesn't mean it's not taxed. If they're like me a new tax disk sits in the pile of trash on my desk for weeks before I get around to doing anything with it!
I realise that failing to display the disk is an offence in it's own right, but it's a bit minor and technical compared to not actually paying the tax. It's not as if rozzers need to see the disk these days, they can find out in seconds anyway if the vehicle is taxed and insured.Je suis Charlie.0 -
